18 year old girl, only bought her new car 3 weeks prior was at at intersection turning right.Bus heading towards her and turning left at same intersection. Both have the right of way right!Girl considerately waits for bus knowing it will need more room to make manoeuvre.Bus driver cheerfully waves girl through - she proceeds and gets t boned by a car travelling up the inside of the bus where she couldn't see.Yep,she failed to give way, and accepts that.Owner of other car (and who was the passenger)-is 18 also, male.Driver of the car was a friend of owner, but not licenced to carry passengers.Owner of car makes false statement to police saying he was driving.Ok, whatever.Girl's new car not insured, was unable to get new insurance after earthquake and slack boyfriend hadn't added it to his policies like he was supposed to.Boy's car had 3rd party.Girl feels stink losing her car, and offers boy $600 towards repairs to his car.My thought's are, that neither party are insured, both are out of pocket, but good on girl for trying to do the right thing.Boy's father steps in, starts bullying girl and demanding $1200 payment for car.threatens her with court action etc etc.Is she legally liable for damage to his car if neither has insurance!

What did the bus driver do when this ocurred!

You offer money, and they always want more money.
I'd have cut and run.

Also, one wonders if the bus cameras captured any footage.

girl knows bus driver, but driver didn't stop (failure to assist at accident!)ok, so it was a bus full of school kids - understandable.Bus driver claims to not have seen exactly what happened, but saw the accident

Was in Westport mate - buses would be lucky to have carpet up the aisle let alone camera's!

Jun 8, 5:21pm
double lane intersection & both lanes were going to turn left
kerb side lane has the oncoming car
car comes up too intersection & turns left
girl on opposite side of intersection hasnt seen the car & has pulled out into the intersection, has managed to get directly in the way of the oncoming left turning car car
T-Bone crash happens

Jun 8, 5:25pm
none are insured !
owner of the T-boner doesnt consider his freind driving to be at fault !
girl offered money & all 3 were ok with it - father then gets upset !
or was 1200 asked for & the girl refused &only offer 600 !

Was the intersection controlled or uncontrolled! IE did it have lights. And was the car that hit her turning or travelling straight.

girl turning right, bus turning left, single lane all directions. Boy cuts up kerbside of bus and T bones girl as she turns.
ladyjet1,
Jun 8, 7:19pm
I'd say T boner doesn't want Dad knowing mate was driving car.Girl knows guy (owner) and wanted to do the right thing, offered $600.Dad gets involved and starts bullying girl.
ladyjet1,
Jun 8, 7:20pm
T boner had 3rd party only, and girl couldn't get cover at time because of earthquakes when insurers wouldn't take on new policies, stupid boyfriend was supposed to fully insure car under his existing policies. and forgot!

Thanks, she's my baby girl, and gutted about losing her car, but trying hard to do the right thing :(

first thing she should do is make a statement to the police about what happened and who was driving what to cover herself, I'd say if T boner was coming up the inside of the bus on a single lane road he would be in the wrong as he should have waited until the bus had left the lane before proceeding

Wow what a tricky situation. Hard to accurately say who was to blame. I would say the bus should have proceeded through the intersection instead of waving the girl through. The bus had right of way and should have proceeded. Had the bus done so the girls vision would not have been obscured. Well that's how i see it.

So had the bus proceeded the guy up the inside should not of even been there. There are times where you land up in a no blame situation (both parties are partially to blame) but it's not who is right and who is wrong it's what you can prove in court. I wonder if the guy is having a go cause he can easily intimidate the girl, if it was a tattoo'd Samoan bloke I'd say he'd be less than keen to be so overbearing.

The bus and other vehicle were approaching from her right or her left! Impact to her car on the left or the right! (Sorry, but I can see more than a couple of layouts that work with your description). Was she on a GIVE WAY or STOP!

I'm struggling to understand how she could have not seen the other car if it was approaching from her right and between the bus and the kerb. The bus is turning left. but is it approaching from her right!

Lesson learned, never ever go against the road rules when someone waves you on.I hope your daughter comes out ok. She should ditch the covering for boy (boys mate-driver) and make an honest statement to the police. at least she knows in her heart she did the right thing.

IF a vehicle was overtaking the bus up the inside as it turned, and she waited for the bus to turn first cause it takes up more room, how did she end up hitting the other car!
if the vehicle was tailgating the bus and she didnt see it after pulling out after the buss went, then yes, shes at fault and a police statement should be laid. but if the other vehicle was overtaking up the inside and she went before the bus, thats different. depends whether other vehicle was in a lane or the roadside shoulder

was it a schoolbus! T boner should have been going maximum 20kph and would have been able to stop. cops will sort out blame if so.
ladyjet1,
Jun 9, 8:25am
girl was turning right, oncoming bus turning left, boy went up inside of bus to go straight thru and hit her on passenger side.Yes, theoretically she is in the wrong, and I've had her go and make a statement because I'm 800km away and don't like to think of my girl getting heavied by a grown man!I've told her now not to offer a bloody cent!Boy was happy to settle for $600, he knew neither were insured and saved being in the shit with Dad for having someone else driving his car.Now he will have the issue of making a false statement to police.
ladyjet1,
Jun 9, 8:27am
yep, was a school bus, but kinda sorta he wasn't overtaking. if you know what I mean, and he may have even been going 20k, I guess the cops will sort it, although they're not too bright in Westport.

No. Only if the bus had stopped for the purpose of discharging or embarking school children.
I still don't understand which direction the bus was approaching from.
