Parked in bus lane, ticket, legality?

Ticket for $60, "parked in special vehicle lane" (Symonds St downhill outside Symonds Centre), 8 pm on Sunday.

I'm a bit pissed about this 'cos I wasn't really even aware I was parking in a bus lane. The sign marking the lane is 50 meters up the road and the lane is not painted solid green as they tend to do. It's not like I was consciously thinking about it at the time, but I assumed it was just a normal set-up with pay-and-display (which I didn't bother looking at on account of the time and day).

My real issue is that there is no yellow dashed line on the side of the road, which seems to me the only fair way of marking the side of the road permanently parking-forbidden.

Anyone got any serious input on the legality here! Biker!

I'd say you were bloody lucky not to get towed.I doubt there's any technicalities you can argue over; check the ticket carefully for all details being correct and definitely wait for the reminder notice before paying.

Me and the other 20 cars parked there. Not that the sheep effect is any excuse.

My issue is the total lack of markings. It was not obvious to me that it was a bus lane. No green paint and no "no parking" signage whatsoever.

Incidentally I saw several buses go past the parked cars, in the left hand lane, plenty of room left for them regardless of all the cars!

2.3(1)f of the Road User Rule is the one saying you're not allowed to be there.

However you'll need to source from the council the actual details of which bit is or isn't a bus lane, and what signage they are required to have in place. Have you revisited the site to see what is there! Maybe some signs have been hit/removed!

Yeah, spend a sh1t load of your petrol and time photographing, telephoning, writing, etc etc .all because you are insulted at having got a $60 ticket for parking in a bus lane; which you were. That's the spirit!

6.6 of the same Regulation talks about not parking in a special vehicle lane. So I doubt I have the law on my side. The issue would revolve around whether it was adequately marked (I say not; since I wasn't aware of it and I don't consider myself to be all that dumb.).

I have photos of my car at the time. As I explained in the OP, the lane is not painted green, there are no yellow dashed lines, there are no "no parking" signs. Only at the start of the bus lane, about 50 m up the road, is there a green section of the lane with a "Bus Lane" sign on the pavement.

Where would I find the requirements for marking a special vehicle lane!

As above, it will be outlined in the local authorities own by laws. Dunno where you get them.local authority I imagine.

You have already outlined here why you think it isn't a fair situation, can you not use the same reasons to have the ticket reversed, if as you say the lane isn't adequately marked as a no parking zone then they may waive the fine and erect proper signs, you could also suggest that they mark the zone with a broken yellow line to indicate the extent of the no parking area. at least this method won't add cost to your battle apart from posting a letter
