Anyone had bought from "Wiseguy" wireless reversing camera! He has been taken down by TM and now in Facebook as Import Ways.I want to know what was the warranty period for the reversing camera while he was trading in TM. Mine died before 3 months and he said no warranty. Thanks

I hate to sound like a chump but its just another example of cheap crap being sold, and one more reason to buy from a store that you can physically go and get another one. while the fly by nighters keep selling junk on TM

He is not meeting his responsibility's under the consumer guarantees act. Take him/her to the disputes tribunal and report him/her to the commerce commission. (I assume there is someone you can notify there)

Does the trader in TM comes under this, i.e. report to the commerce commission. As for contact, I only has his email address.

Yes they do as its a new item

IIRC it depends on whether you bid on the auction or clicked by now

The Act only applies if you buy goods or services from sellers "in trade". This means it does not cover private sales or goods sold by auction or tender. However, it does cover goods sold in second-hand shops and sales, and goods sold over the internet by New Zealand businesses.

The Commerce Commission will not be interested unless he's been doing this to a LOT of people.

If you bought using 'Buy Now' the provisions of the CGA apply in that goods must be of merchantable quality and durable and last a 'reasonable' time. By no stretch of the mind would less than 3 months be considered reasonable.

If you saved a couple of dollars by bidding only, you're on your own.

You'd think TM would put this fairly pertinent information on EVERY auction near the 'Buy Now' button. But I guess then you'd be able to see who the rogues were as they'd never have 'Buy Now' and that would affect TM's bottom line.

So if you used 'Buy Now' and the trader has refused to replace or repair, your only option is to lodge a claim with the Disputes Tribunal at your local District Court.

The Govt is looking at changing the law, so auctions are covered; but you may be out of luck.

tonyrockyhorror, Feb 28, 3:21pm
Only 'competitive online bidding processes' and it's only a private members bill - Dr Jackie Blue. Live auctions won't be covered.

The proposed change is unnecessary and takes away people's choice to pay a lower price and discard the consumer protection.

To bring into the Dispute Tribunal, will his only contact which is email do!
Thanks

It really is the luck of the draw, they are so cheap, if they break, you basically buy another, the profit margin on those are pretty slim. You can always buy direct from Asia, and pay as much for shipping as the product costs. I was pretty lucky, as my first camera didn't work from the word go, so I got a replacement on the spot, but it was the remote receiver that wasn't working.
