Was just directed by a friend to the Commerce Commission Site - Fair Trading.this describes our case perfectly and doesn't mention having it in writing at all! I copied and pasted, so this is word for word!
Inertia selling
Inertia selling is the practice of providing goods or services to people who have not requested them. Consumers are often incorrectly told that unless the goods or services are expressly rejected, payment is expected.
The silence of a consumer is not enough to indicate they have accepted the goods or services. Businesses can only demand payment where the customer has clearly agreed to accept the good or service. Where there has been no acceptance, any demand for payment is likely to break the law.
In inertia selling situations, consumers are protected by the Unsolicited Goods and Services Act and the Door to Door Sales Act. Any attempt to mislead a consumer as to their rights under those Acts is also a breach of the Fair Trading Act.

Post #5 you say your sons friend took it in, and agreed to the work and parts, how does your last post relate to this they rang him being their customer he agreed to the work. Doesn't sound unsolicited to me. Your problem is with your sons friend not the auto sparkie.

Thanks for replies:) We will hopefully get it sorted. Yes evotime, we understand that too, just shocked that nothing was written down by the Auto Business before any work was done, stipulating costs or conditions - whether with the Mechanic (on behalf of us) or on contacting us to confirm (in writing) - we could then have done something about it. We were under the Impression A: They were still 'looking' at it or B: It was being fixed within our Budget as told to Mechanic:) Thanks again all.also to 3tmany, appreciate your thoughts.may be an option:) Have a good night all

it wont be a new computer either . not for $800 for total repair. more likely another s/hand unit. if that was the fault in the first place.you wont know til you drive it at this stage you only have their word for it that it's even fixed

if it makes you feel any better i had a tractor that was showing random temperature readings so rang the locol dealer to fix. after spending all day thinking it had a loose or broken wire and replacing thermostat and sender unit and finding nothing made any diferance he went back to base and decided to try a new computer. what do you know that fixed it. computer $3100 + all the other work and an engine oil change done while he was there grand total$5800

Just a suggestion, why don't you go and take photos of the car, list it here on TM, interested parties can view it at its current location. Start the auction at a level that will pay the bill and any extra you keep.

Sorry, its not the workshops fault. they were authorised by the driver to do the work, so they went ahead and did it. They dont have to get permission in writing to do the job, as they had verbal approval. They can also put a workers lein over it if you threaten to take it away, this means they retain ownership of the parts and labour they have done to it. I think it sounds like you are resigned to this, I guess you just need to cut your losses, get what you can for it. And I agree, sell the PP seperately, that one should be worth a reasonable amount.

Same thing happened to us, repair was supposed to be $150 and ended up being 500 with no authorisation.My son paid it because he was too gobsmacked to do anything else.i went down and negotiated a credit that included a full service and two warrants.the garage owner knew he'd stuffed up and I pointed out that he would lose two loyal customers.Never get work done without authorisation.

Son's friend said to do the work therefore he pays.If you authorised te work with the garage why were they getting ok from the "friend"!As far as I can see you owe the garage nothing.

Thanks everyone for all your imput, sympathy and advice:) It is much appreciated.We have found a way to pay the bill in full, so will get the car back, reg and warrant it and hopefully sell it.can't see the point in having it out with sons friend, but I sure as roses, won't be recommending both these tradespeople to anyone in my future travels;) Thanks again all, have a great weekend!

Mitsi CPUs are well known for playing up.
$800 seems a hell of a lot to repair it but I am not sure if that was all that was done.Normally costs a couple of hundred to get them repaired and they are very easy to get at.
The fault is with the sons friend not the workshop.He shouldn't have given the go ahead for the repair without talking to the owner first.Probably thought he was helping out but it is always easier to commit someone elses money rather than your own.
