Get with the program mate, public liability will not and does not cover vehicles parked on the public highway period!

I think the crux of this is that is WASN'T the owner, but rather, it was the garage employee that parked the car on a public road.

The owner left the vehicle "in the garages care" until the job was done & until the owner picked up his vehicle.

With some suggestions that the garage isn't liable in any way simply because the car was parked on a public road & not the garages property, is pretty much the same as you bringing your computer to my place to be repaired & then after the job was done, I placed the computer outside on the footpath next to my mailbox & it got pinched BUT . it's NOT myproblem because it wasn't on my property

Path of liability.

Yes, in the 1st instance of blame,the truck driver needs to be found because it's his vehicle that hit the stationary (parked) car.
2nd, the garage for parking it OFF the garages property without permission while under their care.
3rd, the cars owner /insurance at the end.

I agree. Surely any reputable business would put their hand up here, regardless of what level of insurance either party has.

well for a start I would be p*ssed if they parked my car on a public road rather than there own carpark!

From past dealings with the Desputes tribunal I wouldn't be suprised if they decided the garage pays. Well worth a shot as a last resort.

well said. It was in the garages care at the time. At work we have had to pay up for similar incidents of damage, its unfortunate but it happens. Try the disputes tribunal even if they award fifty fifty. But see what the garage wants to do first be polite and carm.

So you think the owner should be out of pocket when it was under the workshops care. Regardless of what insurance we have, we would do our best to put the situation right.
