Just wondering on your thoughts on this.

My wife was picking a group of kids up early Sun morning (2am) from the McDonalds in town.
Her car was locked up and parked about 100 yards from where she was standing in the carpark.
Boys in blue pulled in and asked if she had been driving at all tonight & put the bag on her.
Just curious as to the legalities of this practice,when the car had been parked up for half an hour.
She was out of the vehicle on the other side of building, and the police only asked if she had been driving never observed it.
If she had of returned a positive, how would it be enforced!

probably like they done dotcom. In germany the top of the police all got sacked nz should sack the police also as they are far worse then for what the germans got sacked for.

Police are getting so much lazier . I've seen them "pull over" people that are paying for gas at a gas station late at night . New practice maybe!

Ummm, if she said she was driving, then there is sufficient evidence that she was driving. If she blew a positive in the BST, then there is sufficient evidence she may be over the limit and an evidential breath/blood test will ensue.

Problems with that!

And what is lazy about questioning drivers at gas stations dylandyldlylandyl!

And so you have never seen police question a driver at a gas station before this last time you witnessed it. Therefore they are getting lazier. That's quite lazy research from you there Dylanlalyndlyllydy.

Firstly she said she was (had been) driving (her own admission).
Secondly, if she was over the limit at the time of testing, then theoretically she was over the limit at the time of driving (I presume she wasn't standing in the carpark drinking alcohol).

Dont recall the Police using the "bag" anymore to test people for alcohol. Crimianls still need to stop and buy/steal petrol from the servo so good work by the boys/girls in blue in stopping people there.

if she was over the limit at time of testing, who was to say she didnt have a big skull of sprites, then drive and arrive at under the set limit. one hour after arriving she would/could be over the limit but was at no time over the limit when she was driving

Whatnextcome to your door&ask if youd been driving & put thebag on you . Getting to be more of a police state . She should haverefused both questions .Only required to give Name & address if asked by cop ,not toincriminate yourself .

If she hadn't been drinking (OP doesn't actually say.) and hadn't been driving for 30 mins, in what way would she have incriminated herself!

Actually, the good folks at fuel stations, Maccas, BK, KFC etc often ring police if they suspect a driver of being impaired. Maybe that's the situation you saw.

The first problem is answering them when they asked if they had been driving.

The second problem is that people let them get away with crap like this.

Nope, no more to the story. Car was parked up for half an hour because the young'uns wouldn't stop yapping and get into the bloody car, had been to a party and their mother was picking them up from maccas.
No she hadn't been drinking, as she knew she was driving to pick daughter & her mates up later.

Well, firstly it appears she wasn't intoxicated and so was happy to be honest in her answers. No problem.

Secondly, it's dimwits like you who think an attempt by the police to prevent a drunk driver driving a few kids home is 'getting away with crap like this'. Big problem.
