Clamped motorist avoids penalty

noswalg, Jul 20, 9:15am
WTF, how is a conviction not a penalty! Some muppet interferes with his vehicle, he remedy's the situation and ends up with a conviction for his troubles. Government regulation is long overdue here IMO. http://www.stuff.co.nz/motoring/7315556/Clamps-held-to-ransom

Bet that ginger tosser clamper has loads of mates.

trader1292, Jul 20, 9:47am
Bet that ginger was teased at school so now he flexes his 'power' to the max

How did he remove three wheel clamps!
We should be told.

sifty, Jul 20, 9:53am
yes that is a good question.

bloody nice of him to offer them back i say.

sharchew, Jul 20, 9:53am
He looks like a tosser a small one

noswalg, Jul 20, 9:55am
I wonder what the preferred method of removal is! For 3 clamped wheels I imagine an angle grinder in the boot would be effective, after all if a private party without crown imposed powers attaches something to your property doesn't it then belong to you!

dunedin_moto, Jul 20, 9:56am
299 'friends' on Facebook;)

sifty, Jul 20, 9:57am
Yes I always imagined a cordless angle grinder with cut-off disc to be the best method.

sifty, Jul 20, 9:58am
haha that's about 289 more than me.

gutted.

smac, Jul 20, 9:58am
He was charged with theft, no mention of damaging the clamps. I'm guessing he has a spare set of wheels at home.

fordkiwi27, Jul 20, 10:07am
a theft charge is a bad one .

smac, Jul 20, 10:22am
Yup, which is why it's IS kind of a big deal that he was not sentenced. The court is pretty much saying "yeah you took some stuff, but in this case nobody cares".

noswalg, Jul 20, 10:34am
Yes I think he may have let himself down by removing the clamps from the carpark, I'm sure that he has every legal right to remove them from his vehicle seeing as there is no legislation supporting the use of clamps. He could also try his luck by lodging a claim with the disputes tribunal to recover the costs of removal.

friendly_prawn, Jul 20, 10:48am
The law is weird. If he did move his car like he said he did everything right.
there for the clamper would have surely been illegally interfering with his car. So shouldnt the clamper have been charged with unlawful interference of a motor vehicle!
If any one else unlawfully interferred with a motor vehicle the police are quick to charge them.

rsr72, Jul 20, 11:16am
He probably made the mistake of ransoming the clamps back to the clamper for $150, therefore incurring a theft charge.
Phoning the clamper to tell him to just pick 'em up may have been the better solution.

friendly_prawn, Jul 20, 11:20am
Good point, he probably would have been better off giving the clamper a bill for time spent removing them. Then he could have tried to enforce it through the small claims court. He may have actually got lucky.

rsr72, Jul 20, 11:28am
- good point.

noswalg, Jul 20, 11:34am
yeah good point

moosie_21, Jul 20, 8:35pm
Would have dumped the clamps at Egmont Hut and told him to collect.

pollymay, Jul 20, 10:50pm
I'd of sold the clamps on trademe to try get in the cool auctions and caused a massive stir

daves01, Jul 21, 1:53am
It might not be practical but I've always liked the idea of removing wheel clamps by pouring liquid nitrogen on them and then smashing them with a sledgehammer and hopefully shattering them into small pieces .I've got a sledgehammer in the back of my ute, just need to work on the flask of liquid nitrogen
