yes unless he makes you to sign some forms that you cant. normal rules apply the guy kaz would be able to tell you all things he is a car dealer.

Only if it is a fault that is unreasonable. Then the dealer may chose to fix it or refund. It is his choice what he wants to do. You can't return it because you don't like it or it has a patch of rust the size of a pin head.

if i was a dealer i would not even deal with 3k cars. in europe my mechanic mate would only buy cars for reselling if they where under 10 years old.I once got a 6 year old hyundai pony for 1600$ what a nightmare serviced it newwof and then took me almost a year to sell it for 2500 some tamil purchased it for his wive in the end. sold the heap as is where is already started to rust.

Here we have very little comeback on $3000 cars but we don't deal in old Euros. We have more problems with late model Euros than old japanese and austrailian cars. Also if we get the feeling that the buyer has very high expectations of an old car we don't sell to them.

Did you buy the car off the yard or did you buy it as an auction
What do you mean you are not "happy"!
If you just decide you don't like a car you can't return it.
If its got a mechanical issue and its not an auction car then you should contact the dealer

i bought it off a auction on here.but its from a car dealer. the problem is it idles to high, higher wen its hot then wen its cold. its got a new warrant on it but i reckon if it ook it to vtnz today it would fail, little things like the horn is very dodgy, goes wen it feels like it.

there is also something wrong with the steering, huge slack in it and feels like you driving in gales at all times wen there aint even a breeze

As it is an auction, the CGA (Consumer Guarantees Act) does not apply, and reading the auction description the dealer also goes to some trouble to make sure people know about that.

"Sold by NO RESERVE Auction, as is where is. VIEW TO SATISFY YOURSELF PRIOR TO AUCTION CLOSING.
Consumers Guarantees act does not apply to any Auction ! "

I'm afraid, you're out of luck on this one.

Jacqui- Basicly they have well and truely covered off that the car is sold AS IS WHERE IS.
When you posted on here that were looking to purchase the vehicle I recommended for you to have a pre purchase inspection carried out.
You chose not to.
About the ONLY recourse you may have is against the garage/testing station that issued the WOF if there are WOF issues.
Im sorry but this is EXACTLYwhy I reccomended a PPI
You either buy something knowing theres a risk involved or you buy from a reputable dealer so you have comeback. If prepared to gamble then at least test drive the car first.

ok thanks . im goingto take for warrant anyway to see what happens.

auctions are hard, and i think sellers know this. that you dont want to fork out over a hundred bucks for a vehicle if you do not know what its going to sell for, if i KNEW this was 3k to start with i would of gogtten a ppi done . but i didnt know. for all i knew it would have gone to 5k like some others i have watched have. and if i had gotten a ppi on every vehicle ive looked at to date and been interested in, id have pent 3k by now and still not had a vehicle

Well then you need to go and look at some set price listings from some dealers. You may pay a little more, but you are covered under the CGA.

Remember that a pass for a WOF means that at the time of testing it met the required test.So if the horn is dodgy it could well have worked perfectly when checked.What are the idle speeds!Have you checked the tyre pressures are correct, are the tyres a matched set or a hash of all sorts, should they be rotated to get pairs etc!.All things considered I would think you paid about right for a 20 year old car with that sort of Ks.It only sold for that price because thats what the buyers though it was worth - the others that sold for more quite probably were better cars.I agree Auctions are a risk, and a huge one when buying unseen, and that is part of buying at Auction you have to take a risk.Sometimes you win sometimes you loose.

Kaz. I was under the impression that if you buy froma dealer and it was a $1 reserve auction, the CGA rules didnt apply but if it was a Higher reserve (like $3k) you were still covered by the CG Act.Am I correct on that or not!

No its still an auction. It could have been $1,000,000. Still zero recourse.

Only when the auction has a 'Buy Now' option and that is used by the buyer, is there any coverage under the CGA.
