If you buy privately, you're not nearly so well protected. The Consumer Guarantees Act and Fair Trading Act don't apply, although in some circumstances the Contractual Remedies Act does apply. If a private seller misleads you about the car, you can take them to a Disputes Tribunal.

Yea when was that dated.Last I heard was that you where covered on a fixed or offered price but not a auction.this is the same with every listing shoes or your house.But i could be wrong.I was wrong before in . 1977 I think.

That's right.the CSA and FTA don't apply to private sales, but the CRA does!
Gotta feel sorry for that lady on TV a while back that sold her mobility scooter at her garage sale to a neighbour for $800, who one month later wanted his money back because the scooter was 'faulty'!
She said no, as it was a private sale and it had just been serviced and was working fine when she sold it.he even rode it home!
He took her to the disputes tribunal and WON under the CRA.
She couldn't afford to pay him back, as she'd used that money to help buy a new scooter, so the bailiff came around and took her new scooter away!
It was sold at Turners Auctions for $200 and she had to pay the other $600 on the drip feed from her benefit.
Thankfully after seeing the story on TV, lots of people offered to buy her a new scooter.sometimes the law is an ass!

Its just mind boggling to me that so many people think they have easy come backs on privately sold cars.Alot of people in this country need re-educating on a few facts!

How on earth could the buyer have won that!Surely for the CRA to appy there had to be some fault in the contract not a fault in the item.

Unfortunately the DT is a law unto itself and some of the decisions do make you cringe.i know of a case where a dimbulb drove straight into the left side of a car at a "T" intersection.DT found that the car driver should have anticipated her stupidity and got out of her way.Didnt of course say how that was to be achieved.
