Im playing around with a couple of old trade ins at the moment. Quite honestly they looked like they had been dragged out from under a hedge where a family of tramps lived in them. Ive given them a huge clean up. Not the least of which being removal of the interior and water blasting the carpets and seats. Anyhoo --the car that was traded is a far cry from what stands out the back now. Darn things look like they were cars someone cares about. Then I got to wondering. What would YOU doifa deal went belly up! Say you had spent a fair few hours and a thousand dollars or so on the car to get it tidied up and mechanically sound and for some reason the buyer expected their old car back!

Is there a legal requirement to "give the old car back"!What if you had already onsold it!In your hypo case I'd say that the "old" car is available and you are happy to unwind the deal but they will have to pay you for the work done on it whilst it was in your ownership.Start at a couple of grand by the sound of it.

I know in the old days (prob changed rules now) but a second hand dealer had to hold any item purchased for resale had to hold an item for 30 days. Does the same apply to vehicles!

Charge them for the work.
Plus, if you've rego'd the one the bought for them, charge them a fee for that too.

I'd go with supernova2.BUT ! . some times the law and logic part company !you may have to give it back.if so. what condition are you going to give it back to them !. if it was me, the POS would never run again, if you get my drift ! . then again the people asking for the car back may say it was in pristine condition .ahhh , and that's where a picture paints a thousand words . did ya take any PHOTOS!

In the worst case, you would only have to refund the value ( in cash ) that you traded the car for, not give their old car back.

no,they could demand the car back, that's if the law let them get that far

How could they "demand" it! A contract is a contract, if there wasn't an issue with the newly purchased car, I don't see what rights they have to their old one

Bugger that, a deal is a deal. They had no problem selling you an unsaleable POS and expected it to have value against what they were buying. The fact they gave it to you in that state proves they didn't give a stuff about it, why would they want it back!

Why would anyone 'expect, their old car back after trading it in! If they were too good a customer, or you were too nice a guy, to want to argue I'd at least have them pay for the work done. Couldn't be fairer than that.

if the deal isn't done yet and no contact then you just cleaned the car for them free if the deals done do another deal for what ever money you want.

This is purely hypothetical. As I was sweating my guts out scrubbing the dirt out of the seats I thought-"gosh I hope this person doesn't want this back now Ive done all this work"

maybe if it's on the same day that they traded it, and you were willing to unwind the deal. Otherwise, buying ( trading ) their car off them is a separate transaction to them buying your car. It's only the funds from their trade-in that you apply as part payment towards the new car. Of course the old car would be long sold if the sh*t hit the fan later on!

well simply you should wait the required period when the deal cant not be reversed. otherwise its negotiation and you could loose out.

I kind of think "a deal's a deal" so if they want it back it's tough titty for them. Unless you've misled them about something in the deal (which we know you wouldn't have).

This is in case it is stolen goods. Nothing to do with someone changing their mind and wanting it back.

cant remember the exact details, but several years a bloke traded his hillman hunter on one of those minimum trade in deals. For some reason he returned the car he bought and cancelled the deal and wanted his trade back. The dealer had sent it to the wreckers or the auctions and had to give him $3500 in cash as that is what it had been traded for
