AVIs and loud exhausts

We have heard from various AVIs on here about how they are required to fail certain things according to the VIRM, but one thing I think that is being ignored is loud exhausts. The problem is that the VIRM is rather vague in that it allows AVIs to "guess". But it is also clear that if there is any doubt about compliance, it is a fail and the vehicle needs to undergo an objective test. I know there are many vehicles in my neighborhood which should fail as they are horrendously loud, but pass every time. Not changing exhausts at WOF tome either - I have heard them go out, and come back, and in the meantime the new WOF has showed up on carjam.

Some might say they are half the problem
they need to HTFU and fail the loud ones
driving a modded noisy car has to remain one of the most common and inconsiderate
acts the "look at me" clowns can do.

Yes, and I must say the worst one I ever struck was passed by VTNZ. I proved this particular one was well over the legal limit and eventually got something done about it, but that's another (and very involved) story.

well i'm driven up the wall as much as the next person by noisy exhausts-in fact, just yesterday i was quite depressed by hearing a (unmodified-therefore extra 'droney') 4 cyl automatic go up a long hill about half a km away, with a 'drainpipe' exhaust, the drone amplified by the natural surrounding valley, however, i do choose (at the moment at least) to live in a city-with both it's good and bad points-and i have been to countries where it wouldn't be tolerated (in europe-germany in particular), and fun is also barely tolerated there, and it's a kinda scarey slope you start on when you check up on your fellow citizens' legal compliance., and it's also very non-kiwi.

I don't get the connection between compliance and fun. Are you saying it's not possible to have fun unless you ignore regulations and have no consideration for others! I beg to differ. If my idea of fun was to sit on my deck drinking and throwing the empties over the fence into your garden, I'm sure you would find that unacceptable. Why should excessive noise from an illegal modification be any different! Totally in favour of fun which does not impinge on the rights of others, and I suggest most people comply with this.
