Requesting a Court Hearing.

trogedon, Jan 9, 11:52am
What are the costs involved if it you (I) make submissions or the decisions goes against you (me)? What to state on the request?

saxman99, Jan 9, 4:13pm
Court costs can be higher if the court is unimpressed with you or thinks you are wasting their time or disrespectful etc. I've seen $130 costs handed out plenty of times.

advice - if you think you have a good defence, its a gamble how much you say. Tell them what your defence is and youre giving the the chance to counter-argue you.
They are required by law to provide you with EVERY bit of information / evidence they have.
You are NOT required to tell them ANYTHING about the content of your defence untill you are in the courtroom and present your case.

llortmt, Jan 9, 6:39pm
Are you not obliged to exchange evidence, i.e. provide them with any evidence YOU will rely on in court?

bumfacingdown, Jan 9, 6:54pm
Yes, I think the $30 is a tad out of date

tigertim20, Jan 9, 6:54pm
NO!.

bumfacingdown, Jan 9, 7:09pm
For nonpayment and court enforced payment, that is not for a disputed/defended court case as far as I know but no doubt some one here knows the correct amount and I stand corrected if wrong.
ps
Found this although it does not state the cost
"If you want to start court proceedings, we will transfer the matter to the Ministry of Justice and they will contact you. They may add court costs in addition to any penalty."

No. If you receive an infringement notice you can either accept it and pay, or if you wish to argue against the infringement then you are entitled to be given all the evidence against you so that you are able to prepare a defence and present that in court.

The person(s) sitting in judgement weighs it up and makes the decision.

Motives for defending an alleged infringement vary, and it is a process that can take time and money.

It can be worth while finding someone to act as a 'devils advocate' and give you a hard time. Someone that can clearly see the situation and talk to you about it. It may save time and money in the long run.

There is some truth in the saying 'that a man who is his own lawyer has a fool for a client'

shouldn't plead guilty all the time then.

easier to not speed maybe, or is that just beyond ya "skill" set.

mrfxit, Jan 10, 6:13am
While there is a certain amount of useful truth in the above statements, I have also found over the years that those who know the court systems well are either .

Legal practitioners/ advisers of some sort
OR
Trouble makers of their own design.
OR
An extreme minority that attract troubled attention for no apparent logical reason.

trogedon, Jan 10, 6:21am
This wasn't speeding, in fact I was doing nothing wrong and the senior Police officer investigating the other officer has already apologised to me but I still have this unnecessary fine ;-(

That's right.
trog wears lycra.

If you were doing nothing wrong and senior cop agrees why hasn't clerical functionary processing your ticket been told to accept your story? If it was up to the individual cop's discretion then senior could still apologise for the other one being a dick but can't make it go away.

trogedon, Jan 10, 7:00am
There are two parts to this; 1/ the stupid cop who gave me the ticket and his own dangerous driving/attitude etc and 2/ the ticket. They go through different organisations/processes.

Do you read? Do you read through threads before putting comments? Didn't think so.

trogedon, Jan 10, 9:43am
Jealous much.

trogedon, Jan 10, 7:07pm
You know, I believe you.

trogedon, Jan 10, 7:08pm
Did it. I requested the hearing at the nearest court to me and I mentioned the photo evidence and the witness statements I would be presenting.

mrfxit, Jan 10, 7:25pm
Have to disagree with that chunk of sad sack sarcasm.

Considering the huge amount of work & the vast numbers of people that police have to deal with & the fact that a lot of those people are aggressive to them for various reasons (mostly booze or drugs), I believe that they do a dang good job most days

trogedon, Feb 20, 7:37pm
I can imagine they're never out to make it easy for the defendants. I've done teleconferencing for civil court.
The person who reads my request (so I shouldn't have bothered stating stuff) won't be the person running the court / adjudicating anyway.
