I think that dealer is more implying that the winning bidder is bound by the rules to purchase the vehicle.

Not so much there being no mechanical comeback .

Don't know why people get hung up on wording, he's still bound by the law and will have to stand by that regardless of how he's advertised it. I guess if the buyer is unaware of the law it could be to his advantage though.

Yes, and the words "DON'T MISS OUT ON THIS AWESOME RELIABLE CAR! " is sure going to set the standard if the buyer has a problem.

Another thing, TradeMe helpfully added this to the ad "Fuel economy is 4.8L per 100km.". Do they underwrite those figures?

Several of the nationwide big-box furniture and appliance retailers are notorious for pretending the consumer guarantees act doesn't exist and pretending they are unaware of any obligations under that act.

And they are long-established brands with a public image and their identities are household names, i.e. a reputation to lose.

So it should come as no surprise that some car dealers are doing it on Trademe auctions too. ?

I may be going across the grain here, but the way it's worded makes me think that they intend that there's no comeback if you haven't inspected the car and aren't happy with the condition/features/colour or whatever.
I'm sure that any unforeseen failures will be put right. (I hope)

I think the intention of that statement is to say once you've won there is no backing out if you don't like what you see at pickup, as per #8. Its just not the best way of wording it.

At the end of the day what are they going to do? Follow you home? Drag you through the courts & then hope to get paid, all for a couple of grand.
Winnings one thing, getting paid is often quite another.
I think they've worded it like that because they're probably sick of 'winners' of auctions mucking them about.
I've seen, and experienced, auctions where the winner will try to re-negotiate the price down by picking out normal wear or age as a fault.

while i think the cga is a good thing in general, its sucks the big fat one when it comes to things like this. i mean seriously who beleives that some clapped out trade in done 300000kms should be covered by the cga? no wonder trade ins are worth nothing now. the dealer has to cover them. DUMB. if i was bidding on an auction that clearly stated AIWI etc then what do i expect? if it was a fresh import of the yard thats a different story or even a "decent" car, but old banger trades are just that

Today I sold a 1992 Toyota Windom (trade in) with 200,000k for $1500.
Since I am in trade, the Consumer Guarantees Act applies.
It has a new WOF and drives great, but I hope the buyer is realistic with what you get for $1500.
