Thoughts please

First question- are you a Trader? (this will then dictate the answer to your question).

noswalg, Sep 11, 2:29pm
Really? Even after 2 years? Surely a dealer would have fulfilled their CGA obligations after 2 years!

tony9, Sep 11, 2:35pm
No sign of the sale in your feedback, but your latest feedback is hideous. What is going on?

kazbanz, Sep 11, 2:50pm
prt21-Id like to post--"2 years you gotta be kidding me" but nothing surprises me nowadays.
First question I have is--Whats it got to do with mum?
Your sale and all sale documentation relates to the 27 year old

kazbanz, Sep 11, 2:56pm
Ok so you are a motor vehicle trader yes?
Then any discussions of any sort need to be with the person/persons you sold the vehicle to.
have you got a copy of the original advert?-ie maybe a trade me auction?
Have you got the VOSA and CIN card? What do they say ?

intrade, Sep 11, 2:59pm
2 years i wonder do you still have to give consumer guarantee after you sold a car 10 years or what?

gman35, Sep 11, 3:08pm
A) "Confident" or you "Did" ?
B) But anyway and REGARDLESS, the car was bought, it's had WOF's since (or even just when you sold it), how can she expect you to do anything at all about anything ?
I don't see why you need any advice here ?

kazbanz, Sep 11, 3:12pm
So 2 years ago--was the vehicle sold as an as is where is auction?
Back they it was legal.
frankly my response to mum would be."Im really sorry but I need to speak to the purchaser of the vehicle"
If something ever did come of it that would be the path you would be legally required to follow anyway.
If mr now 29 does then make contact you need to determine exactly what he is expecting of you and why

The Min of Consumer Affairs website mentions a period of 6 years for a fault in a vehicle.

a.woodrow, Sep 11, 3:15pm
There hasn't been a fault. It was lowered when sold.

tintop, Sep 11, 3:18pm
It was a response to Intrades comment rather than the op's problem.

tintop, Sep 11, 3:34pm
Interesting thread - I have a Caldina that I will be selling soon.

Lowered .

extrayda, Sep 11, 4:02pm
I don't know the law, but surely after that timeframe it's not your problem.
Who's to say that they haven't fiddled with it since you sold it to them?

skiff1, Sep 11, 4:08pm
Given the lowering has passed a number of WOFs by the seller and the buyer, it can't constitute a fault. Therefore it's simply a feature, like paint colour, stereo or air conditioning. Could you ask for compensation if the car was a colour you no longer liked?

henreitta, Sep 11, 4:23pm
No expert here but a 27yr old guy comes to buy a car, 2 years later mum dont like it
Would have thought a 27 yr old would have known it had been lowered ,has had w o f for past couple of years
mum says ,what are you going to ddo about it ? , nothing sounds good to me
surley even as a dealer which i understand is correct, you cant be responsible after 2 years of motoring

saxman99, Sep 11, 4:26pm
"No problem, see you in court."

supernova2, Sep 11, 4:47pm
Bit OT but we sold a house property 6 weeks ago. Had a ring from purchaser this week demanding a Code of Compliance for the electrical work done in 1973 which was 7 owners before us!
There truly are some knobs out there.

tamarillo, Sep 11, 4:57pm
So, it was sold like that and does not require certification, and is fully legal.
I'd say you're okay op.
Maybe mum doesn't realise it's legal and ok.

matarautrader, Sep 11, 5:42pm
I bet sonny knew right from the start it was on 19s, but didn't let mummy know. Mummy has just found out that her precious wee one is driving around in a non standard vehicle and wants it back to standard to make it "safer" for her sonny boy.
I bet mummy paId for the car and sonny still lives at home.

tintop, Sep 11, 6:51pm
Read and weep :)

"Claims can be made under the CGA for up to 6 years from the time the problem appears.

However, a delay in the consumer taking action may affect or limit the range of remedies available to them.

If the consumer wants to claim a cash refund or a replacement vehicle because of a serious fault, the claim must be made within a ???reasonable time??

kazbanz, Sep 11, 6:51pm
and the OP has gone--what happened?

jmma, Sep 11, 6:54pm
Probably the really bad feedback or the fact he was using someone else's account.
Looks like we are still being watched!

poppajn, Jul 8, 7:37pm
He's gone, no profile, feedback etc, must of deleted his account.
