Makes more sense, however if they are violent then it's best they perhaps take one someone who will just pin them than hit a van full of islanders who will just cut you open with a machete. Not everyone will just pin you if you attack them, not every possibility ends with someone else getting hurt. I'd like to see what would happen if they hit a shop front or some big dude's car in the carpark. No keys, no problem, however if they tend to be violent then it could be saving them from themselves, as much as you don't know if they have a knife they don't either. They're just too thick or easily raged to realise they're not the only aggressor on the planet and that some people carry knives.
I carry a knife, it's a tool, I use it everyday.

Regardless of time of day the above quote still applies. Sure we can turn it in to assault I guess. Do we assault them to put them under arrest or wait for them to assault us ! and surly we need a reliable witness or it just may turn into one of those he says she says situations.

Under the circumstances, instead of confiscating keys, you could use your car(s) to block their car in until the constabulary arrives.

Don't know, wasn't there, but imagine this is 'due process' until the driver is convicted. The passenger has obviously laid a complaint, so they don't have much choice. At the moment it's your mates word against the passenger that the driver was drinking/drunk. I have heard of people attempting to entrap people into assaults/fights etc with this sort of thing. SO police have to cover their arses, in THIS case I don't think they have any choice. If he wants to play them at their own game, why doesn't your mate lay a complaint at the guy that started kicking him! My guess is the complaint against him would disappear pretty quick.
Would be good to hear the eventual outcome.
