It's nothing to do with incorrect interpretation - it's just plain old government department employee laziness and lack of interest in helping individuals.

lou-lyn just to let you know our Barrister Mr Trevor Leigh was super, and got straight to the point and pressed all the right buttons. It was the Crown Solicitor who was pathetic, however in her defence she could only go on what she had been given, and I rather suspect she knewright from word go she was not going to win this one. Also in her defence after it went against her she came and shook my grandson's hand and wish him well and told him she hoped he enjoyed the show. I got the feeling her heart wasn't in it right from the start and she didn't make much of a case. Wish I could go head to head with a Kelly Timms who claims to be "team Leader Assessments" and a Lisa Slade who is Manager Customer Access, but sigh I suppose they are protected from face to face "disagreements". Wonder what their qualifications are!

Then it should have been referred back to the NZTA idiots for reconsideration with a strong recommendation that they grant the exemption and save everyone the time and cost.

Your ignorance about the system defies belief. Beuocrats (it's actually beauRocrats) simply enforce the rules, they don't write them. If you have any grizzle then it's surely with the lawmakers (ie your MP) and not with those who are paid to enforce it.

Ah silly me, I forgot that you hate politicians coz they are all corrupt, deceitful and incapable of making decent laws.

to tonyrockyhorror - surely that would be far too logical! To owene - not not quite sure I follow - I don't hate politicians in fact Tony Ryall did everything he could at the time to help us. He agreed with what I was saying, and in the middle of the election he took the time to pursue it as far as he was able. There is nothing wrong with the regulations, or the procedure that is in place to cover this situation. What is wrong is the stupid people at LTNZ who are apparently incapable of interpretering it.

Here is a new angle - a friend has two daughters, 16 and 17. The parents were overseas returning to Hamilton. Applied for an exemption for the two girls to drive together to meet their parents, from Tauranga to Hamilton during daylight hours. You've guessed it - turned down and told they would have to make alternative arrangements. Who are these people and what planet are they on!

Here is another. Friend has applied to sit his full licence and hasn't heard within the 20 working days stated on LTNZ website. So phoned them. Answer - they have a backlog and can't process in time. I wonder did it not occur to them that with the rule now saying you have to apply for a full licence they would possibly be somewhat busier than usual! They might have to do some real work for a change!

Well the petantic still continues, He applied for his full, licence, which he is entitiled to do, declined till the 26th which is the date his restricted explies. Six days then there they will review it.!

well surprise surprise it is now the 27th and the LTNZ are sadly lagging. Should have been granted yesterday, it will be interesting to see just how long they think they can take. Inc identally, I wrote to the Minister of Transport seeking some answers, and so far have had a bland letter from his secretary saying she has passed it on to the Minister. I do hope they do not think I will just fold my tent and go away!

thankyou smac - the wait is that before a restricted driver who started the process under the old legislation can sit their full licence they have to apply to the LTNZ for an exemption. You have to allow 20 working days - they don't move at any speed. Having allowed plenty of time he was informed that as he hadn't had his restricted licence the required 12 months they would put his application on hold until he had - 26th January.He was informed of this by email one week from the 26th. So far we are up to the 28th so I suspect they are going to take the 20 days from the 26th. So when they tell you you can sit your full licence 12 months from the day you got your restricted, what they are really saying is that it will take 12 months and 20 days. A friend of ours waited and when he phoned he got the usual "sorrry we can't find your application". I have heard that three times so far. He persisted andfinally got it - in 30 working days.The poor wee overworked noddies at LTNZ pleaded overwork and a back log.
I am suspicious that in our case they may be spiteful as we took them to court previously, so they are probably just being petty now. Not to worry I haven't explored all avenues yet - watch this space!

valb1, i've followed this with interest, as i have a 16yo who will be wanting to sit her full license at the end of oct/nov next year, having had her restricted for one full year. She will have done the driving courses by then. :) We live rurally and there is no public transport close to us, so the whole restricted license until they are 18.5 minimum is awkward to say the least.

At present, as of yesterday your grandson no longer has his restricted exemption for curfew driving, and has not been allowed to make an appointment to sit his full license, correct! I hope you get this sorted soon, keep us updated. :)

thankyou zirconium - the exemption we applied for in December was only for a specific time - three weeks of the show he was doing from Wednesday to Saturday, so when the show ended so did the exemption which is fine. Now he is up to the stage where he could sit his full. We applied in plenty of time having experienced delays with these noddies before. We then got an email to say as he hadn't had his restricted for 12 mon ths they would put it on hold until the 26th of this month, which is when he is eligible. On the 26th I sent them a pointed email telling them that I was in communication with the Minister of Transport, and that as things hadn't gone well for them in court last time, it would not be a good idea to cause any more issues.
Well surprise surprise, he received the exemption yesterday. How stupid is all this, a month ago they turned him down to drive outside 10pm as it wasn't safe - now they grant him the right to sit a full licence. Obviously they are not employed for their common sense.
However he is in the same situation as your 16 year old. They live in a rural area with no public transport. Yesterday his mother rang around to find somewhere he can sit his licence. The nearest date is 20th February. So another issue arises. You cannot book the test until you have the exemption, and it is fully booked way ahead. Ho Hum!

thankyou zirconium for your kind thoughts. It will be a huge relief all round when he has his full. Because of the PSA Bacteria devastating his parents orchard his Mother no longer has time to run around after the two of them, and has now got a full time job. Hope you don't have any hastles with the LTNZ when your 16 year olds time comes. I have written to the Minister demanding some answers and also to know what changes they are making to their decision making, so hopefully it will make it easier for the good kids in the future.

SO this morning my grandson sat and passed his full licence! So much for the stupid noddies at LTNZ that at the end of November decided that he was a Stastical risk, What a load of rubbish this is. Suddenly it appears he can drive after 10pm. I wrote to the Minister and got a bland "Ihave [passed your concerns to the Minister" rubbish. I haven't finished with them yet. Watch this space!

I have extensive advanced driver training and a vehicle capable of safely travelling far in excess of the 100km/h speed limit. I wonder what the verdict would be if I took the NZTA to court to get them to allow me to travel at 120km/h on the open road!
