Green stickered on the way home from LVV check

Yesterday arvo I was driving home to Whakatane from Rotorua after running my Cefiro through an LVV cert check.This was its 2nd check, as it failed on a lot of small items just after Xmas.It failed yesterday (wrong type of driveshaft loops and not enough front suspension rebound).I was pulled over about 10 minutes from home, and green stickered for no current WOF or cert.I showed the officer all the paperwork (screeds of it that I had with me) to prove that I was trying to do the right thing and get it all up to spec, and not just cruising round.Still, he wasn't interested and just banged the greeny on.I'm hoping that one of you can let me know where to find information regarding driving to and from places to get WOF's, certs and work done on your without a WOF.I've been searching the net for a while, with no joy.Cheers.

Thanks biker_69, that looks like the info I'm after.papariccardo, I'm well used to police attention, but I put a lot of effort into making sure that my cars are legal and have all the right paperwork.Spead - excellent contribution mate.

Yeah outta' luck OP. Yes you can drive for the purposes of getting WoF, however the vehicle you are driving must be safe to do so. The kicker in Biker's link is 'safe to be operated for that purpose'You've just failed an inspection for lack of suspension travel, yet think you should be OK to drive! Illogical my boy.

Thanks again biker, I know a lot of you guys look at Cefiro's etc as a waste of time, but to a lot of us these are the cars of moment.Also, I'm fairly varied when it comes to vehicle taste, I've had everything from a 105E Anglia, to a manual Senator, and all sorts of Japanese and Euro stuff over the last 11 years.And, at the end of the day, they're all a waste of money, but we do it for the love right car guys!

I don't like my chances of getting off, since I failed, but it's worth a try, as the things it failed on weren't on the initial checksheet, and so to the best of my knowledge, the car was safe:
the operator did not know, and had no reasonable cause to suspect, that the vehicle was no longer equipped or in a condition to justify the issue for it of a warrant of fitness or certificate of fitness.

Agreed, it's about the cars. The issue comes when it becomes about what everyone else thinks of the car, rather than about the car.then you're fair game for derision :)

ummm.an LVV inspector just told you the car was a fail because of lack of suspension travel, and you think you still had reasonable cause to expect it to pass a WoF!! Good luck with that.

At the time he was stickered, yes!

If he had been stickered on the way to the inspection both points (loops and suspension being ok) would apply. However on the way home it should be trailered.

Faults don't really have anything to do with this case apart from the reason for pullinh you up in the 1st place,it's WHERE you got caught & YOUR OWN paperwork on the LVV pins it.

Regardless of WHAT faults there are, the ticket will stick for distance alone.
Whats the distance & time involved to get from Whakatane to Rotorua AND back!
Hard to imagine there aren't other LVV places in the area

biker you're (slightly) misinterpreting what I'm saying, or I'm waffling.either either.

A defense to this ticket comes down to whether or not the vehicle was safe to operate: both the requirement for drive shaft loops and correct suspension travel are part of the LVV requirements because of (perceived) safety reasons. The first because of a perceived increase in the likelihood of a shaft breakage, and secondly because correct suspension helps keep a vehicle on the road. A failure on either of these points by a suitably qualified inspector WILL be seen to constitute 'unsafe'. If he wants to challenge it, good on him, it's his right to do so.

I'm coming from a realist point of view.not an idealistic view. What I'm saying is it doesn't matter whether or not the vehicle was ACTUALLY unsafe.

Woah, this thread certainly sparked more interest than I expected!Ok, to address a few points:
Rotorua IS the closest LVV inspection to Whakatane (approx. 85-90km), the next closest would be Tauranga (approx. 95km).
Yes, just double checked my paperwork, and it is most definately REBOUND not travel that the car was failed (FYI he's happy as larry with my ride height)
Nope, same certifier.Not sure why he didnt pick up on the rebound first time, and as for the loops, I described the way I was going to do them, and he was happy with that, but then when I got there and he had a look he wanted them changed.Simple mis-communication as far as I can tell with that one, it happens.

paparic:Pulled out of a Stop sign into a 70k zone (legally, saw the cop car on the other side of the road) and when I went past him he pulled out and put the lights on.No suprises, as you say, lowered Cef is going to attract attention.He wandered up to the window and asked if I was going to use the car to do skids all over town.I said 'na mate, I've got a caged track car for that carry on' and then he noticed the lack of WOF.Showed him my paperwork, he checked all my lights and indicators etc, sat in his car for a few mintues making sure it wasnt pinched, and then did the greeny.

Biker, na, it definately says no rebound.I'll have a play with the adjustables later and get them sorted, and I don't mind the $200 fine (fair play, it had no WOF), it's just the green sticker that annoys me, especially as I was trying to do the right thing.

Looks like I better bust out my best letter writing skills, and maybe talk to a JP just to get an opinion.I know a few on a personal basis, do you think that would be a good idea, or could be viewed as a 'conflict of interest' if it ends up in court etc!

just a small point.the legislation biker is refering to is for wof and cof.nowhere does it state that it is ok to drive for the purpose of LVV certification. I was always under the impression this required a trailer.

He was driving for the purposes of getting LVV, which is a step toward him getting WoF, ergo, he was driving for the purposes of getting a WoF.

so by your analysis (assumption) a scratch built car going for lvv certification can be legally driven.I dont think so.because eventually he might go for a wof when it is deemed safe by LVV certifier.

it doesn't specifically state 'LVV certification' but it does state 'relevant' certification.not sure if I'll win this one, but I'll give it a go.
Anyway, rough draft of letter is written, I'll re read it tomorrow, maybe get some intellignet and informed people to have a read and give their input, and then blast it off to Wellington.
