You dispute you owe them the money, you did not agree to pay them money for anything, neither explicitly nor implicitly. You did not sign anything, you did not read anything, there was nobody standing at the entrance to their property ensuring you knew the terms, and you did not even see a sign.
Personally, I would just bin the demands. They will be persistent, and I would persistently bin the demands.Eventually they will tire of their game.
If it was a council issued fine, that's a different matter, but a "notice" from a private company. they can't do diddly.

You do actually have to tell them to piss off in writing that you don't owe them anything.
If you don't they will just send it to a real collection agency in time and they won't care.

You could try just writing back succinctly, "I did not enter into any agreement, I dispute this account, I will not pay it unless you secure a judgement against me in the disputes tribunal."
About says it all really. They're not going to the DT over it, a) they'd lose, and b) it would cost them too much.

Enter westfield parking into the left search engine, that thread or threads will probably answer all your questions about Wilsons parking enforcements.

Pap, I didn't know biker69 was in TM detention centre. My post was #82 of that thread. I haven't read the thread but I got a ticket also, from Westfiled Lower Hutt. the following events happened. Jun /2010 parked past time limit. (but I never saw a ticket on the car) Jun - letter with same date as infringement sent to my address $45. Jul - supposedly a copy of the ticket (as I requested), unless the tickets are a huge A4 piece of paper then I don't think this is copy of the ticket. There is no officer or officer remarks in the given space. This was accompanied by a letter saying to pay up and the notice stands. Jul - 21 day payment expired so was sent letter for fine of $65. Aug - Credit consultants debt services advising debt is now $88.91. The client is Wilson Parking. Sep - Credit consultants reducing debt to $65 if I pay. Sep - Jan 2011 - I haven't paid and I haven't heard a thing, and they don't clamp or tow my car when I have parked there since. 7/4/2011 update, I still haven't paid debt and haven't heard from them since.
Thanks to biker69 posting a link disputing whether they have the legal rights to enforce this notice, I didn't pay, plus other personal reasons. They have not continued to enforce this debt. Maybe they will one day, but no news is always good news when it comes to debt collectors. Just my experience, whether you decide to pay or not, that is up to you.

How did you get a ticket on your car if you were picking up a passenger.where were you! Also, have you revisited to check the signage!

If you don't pay and they go under, I'm sure the National Party will bale them out.

I think you're universally right.

The key word is enforcement. They have to have some fool-proof enforcement procedure for it to work,

Yeah, open space and raining is an invitation for opportunists, that's not enforcement thats desparate (clutching at straws), Wilsons, not you.

we parked at a wilson parking place in Hamilton and it was something like $5 for the first two hours then the fees went higher to say $10-14 for 2-3 hours.well guess what. the people we were with put thier ticket in at 1 hour 40 minutes and it said That the fee was for OVER two hours.but of course they didint have the ticket anymore as the machine had sucked it up. so to get out of the carpark they had to pay the fraudulent charge AND they had no physical evidence of the fraud as the machine had the ticket.SCUMBAGS

I got done at the aotea carpark which is a council one, the schedule of fees had a whole lot of different hourly rates etc, but was pinged $12 or somethign because they had some deal for people seeing shows at the aotea center, I was only there for a short time to go get some giapo.
I ran a parking Nazis( sorry 'warden') wee scooter over a while back in my truck if that makes you feel any better Pap;) Was ruled as their own fault too.lol.

any ticket from wilson parking throw itin the bin,, they have no legal authorization to write out tickets. they might threaten you with baycorp but i tell them to fuck off to. wilson parking hasbeen writing out ticket in shopping malls but they are not enforceable.,

papariccardo - I don't think a $65 fine is appropriate if it is not clearly stated anywhere - but they should maybe tress pass you for being on their private property (or leased property).
In the end, you were on their land, but I doubt the disputes tribunal would rule that a 5min stop over is worthy of a $65 fine if it wasn't clear at the time.

Not as amusing as when it happened;) Should have seen their face.they were marking out chalk lines and taking photos like the were CSI.lol. Had a lot of backing from local businesses who were sick of the little bastards.

so what if there are signs, theyare a parking company and cannot write out there own tickets. they depend on idiots that do not know the law to pay up. wilson parking has been taken to small claimsand lost because there tickets were unenforceable,, .
