there isn't any.no past offences - did a fair amount of damage and needed hospital treatment - hence where the cops got him.His bike was at the back of his house - private property.he didn't start it - was just being silly and tipped off.

Dosnt matter, if your in the drivers seat of a car bike whatever and keys are anywhere in sight you can be done. Been around for ages. Bit like saying driving whilest disqualified in a paddock car park is ok, its not either.

If you are in an area which is isolated from the general public then you should be right, as in if you had a gate at the front of your driveway.

It might be private property but it is still a road. As defined by the Land Transport Act 1998 a road is "any place to which the public has access whether as of right or not".

I'm sure you could successfully argue that the public didn't have access on that basis. It probably wouldn't stop you being charged or convicted by JPs but you could appeal.

Mottley something just doesn't add up/sound right about this story I'm sorry. If it is as you say. Your mate basicly used his bike as a seat that just happened to be part of a bike then I'd be argueing on those grounds. But I dunno --if theres like massive burnout marks where the bike is and shredded rear tyre rubber -or simiular I kinda get the copps attitude --and it might explain why they turned up
