Parking enforcement services.?!

Hi Guys.

I've read up a bit on this forum in the past about these people and somehow today when I went to a couple of the local shops and parked in a Free P90 Customer Parking only, within 60 minutes I came back to the car and got a "Unauthorsied Parking $40 Fine"

No doubt I will be appealing this and asking what on earth is going on+ Have a photo of the P90 Sign. But Has anyone dealt with them about this before, or any other matter! Are they quick to respond! Can they damage your credit rating! Can they force you to attend court! It all seems like a big revenue gathering exercise and no idea what the warden was on about.

Seems like some sort of farce

Are you sure it wasn't a pay and display parking! Even some pay and display parkings have a time limit.

Yes im definitely sure . The other area had a P120 Pay and display. No machines here.

Send them a letter, and tell them that you do not owe the $40. Dispute it.

They then have to prove that you have caused financial harm to warrant the $40 'infringement notice'. They are not fines. Only the courts can issue fines.

ASSUMING that this is not a council issued infringement.

Tell them you dispute the charge, that they are welcome to take you to the disputes tribunal, and then ignore any and all further demands.

They won't take you to the tribunal because it will cost more to do that than they would collect, and also, they would lose.

Ok thank you all . Would you suggest writing that in the first letter/email as well! About the disputes tribunal

I assume the DT is $30 + big costs to them in terms of sending someone down too. Even though this is a big joke and they would definitely lose

Is there an issue if you cant attend a DT date by the way, Can they then force it!

yes i have fought them and won,basically write in and say why you are disputing it and wha wha wha and you are prepared to follow it through (make sure you are) and they normally back down they dont want the hassle.

If you can't make the date set, then you can request it is changed provided you do so with a good amount of notice (or a REALLY good reason!).

If you simply don't turn up on the day though, you would very likely lose the case and you would very likely not be able to have it heard again.

But, it won't get that far, they would be losing money to do it ($35 claim fee, which they can't charge you or add to the claim, plus their time, they would be in the hole for what, at least twice what they could possibly collect).

BTW they're not wardens of any kind either. They're nobody losers with no more powers than any other citizen and don't let them forget it.

the parking ticket were not legal,, you have to read there new warning boards,, some have now in there terms if you park here you agree to pay a fine if you break there rules, some parking companieshave been sending out lawyers letter stating they will take you to court for breach of contract.

last month my handicap card fell off my dash board and fell on the floor. i got back to my car and there was a clamp on the back wheel.the clamping guy turned up but refused to take off the clamp until i paid him. i could see the handicap card on the floor through the drivers door window. he said,, to bad the card is not on the dash board you have to pay.i was a ex towie so i thought bugger you.itold him i would ringmy old tow firms and get them to take off the clamp. his boss turned up . i showed him you can see i have a handicap card so his worker should not have clamped me,, he said he saw it but still clamped me.his boss decided i was wrong so i had to pay up and then he threatened me with calling the police if i damaged his clamp. i told him don't be stupid. they won't take off the clamp here. they will tow the car back to base and torch off your bloody clamp. then deny they ever saw a clampor towed me.i think the boss then saw the light. he took off the clamp.

When you parked in thier car park WERE YOU SHOPPING AT THE SHOPS IN THAT CAR PARK or did you 'nip' across the road or visit other shops in the area not relating to the said car park!

Yes, it's illegal for any private entity to attempt to levy 'fines' on private property, full-stop.
- tell them to shove it, with a copy to the local police station.

Stop calling it a fine. It's nothing more than an invoice based on spurious reasoning. They suffer no loss from you parking there even if you exceed the allotted time unless there were no other parks available.

In major shopping centres, like K-Mart shopping areas, there are signs for 2 hours parking, I could spend more than 2 hours visiting the shops with my family and I have seen uniformed employees ( or wardens) not sure, marking tyres with their chalk. Can they issue tickets!
