fair enough - his previous compensation contract should be honoured, or at the very least something similar. If he aint a motorsport fan there is no reason why he should have to put up with the noise and inconvenience out of good will. The promoters run these events to make money , not out of good will.
How would you like it if you were boxed up in your house for a 5 day ballet convention (only fatties , not hotties) and your only compensation was a few free tickets!

I'm usually a motorsport fan but I'm with him on this one. Us fans get to go home if and when we've had enough where this guy and his family are locked into their location. A deal is a deal. The company who brought the rights should have to stump up.

Agreed. Good on him.

Agree with the above posters, all except the Original Poster. What has this man and his family plight got to do with greed or a Tui ad. Seems in NZ now if a company sells the new owner does not have to honour all existing contracts. Surely that is part of the company they are purchasing. I hope some kind Kiwi is in a position to offer them a peaceful place to stay for the final Hamilton 400 event.

Very sad, hope the smarts get their way. just disgusting how they've been treated. if the legal avenue don't work, there's always the illegal avenue. lets hope the smart family don't need to go to that extreme.

this guy has been putting up with this for a few years now, I think the organizers of this event have been given far too much power it is not just this guy affected, there are hundreds of businesses on that track that are being forced to close for the weekend not to mention the disruption the week before and after the race with from what I hear very little compensation, and that is the problem. The organizers are not being forced to compensate, I think a lot of this is to do with Hamilton city council being so balls deep in the whole deal that they had to make it work come hell or high water. Don't get me wrong I enjoy the event and will be there again this year but I think it has been handled very very badly. P.S I'd happily do a house swap with the mill st resident for the 3 days but his house is a bit of a dump.

Wouldn't someone in good'ol NZ'd like to do a house swap for a couple a days then both parties will hopefully enjoy what they choose. Peace and quiet away for one and accommodation and motoring event for the other.win, win situation.

my issue is with the timing - he waits till a week and half before the final event in order to take it to court! Seems he is planning to hold the event to ransom in order that his demands are surely met. I fully agree that on face value it seems that he has recieved unfair treatment, however im a cynical man, and I dont believe a story until I have heard BOTH sides - media is easily manipulated!

Media manipulates more often than it is manipulated.

hmmm seems there is more to it than has been reported so far, - like the fact he has alread been paid 21 thousand dollars in compensation for the events so far.

noswalg,

where has that information come from!
noswalg,

why should he! This guy's property is certainly impeded by the race so I think he should be duly compensated. It would be easy for the promoters to publicly announce that they have offered alternative accommodation for him but they are being strangely silent.

if I was getting 10-15g a year for a holiday for the past 4 or so years I would be upset as well if it stopped. They were onto a good thing, but now it's over. They should just get over it.

http://www.stuff.co.nz/sport/motorsport/6720341/Couple-confirm-Hamilton-V8-race-court-action To quote from above That package - which included flights to anywhere in Australia, accommodation and $5000 spending money - was estimated between $10,000 and $15,000. The statement said Smart contacted them less than two weeks ago with an "opportunistic and baseless claim seeking general damages in excess of $50,000". It's all about the money

Hmmm.interesting.and more interesting why this isn't coming out in the general media. Also, why no word on this from the company!

Freehold apartment owners at HD are debating the restrictions Cocrane wants to impose on them, if he wants to bring his circus to HD - and they are outside the track!
Would you sign a 5 year agreement restricting your rights of access to your own freehold property, in return for four free passes and a limit of six other guests, who would have to pay for a ticket, even if they didn't want to enter the circuit!
It appears that the V8 circus isn't overly welcome at some of the Aus permanent circuits these days, hence their need for overseas venues.
kazbanz,

I'm a motorsport fan but I sure as heck wouldn't want a track right alongside my house. This guy clearly isn't and ONLY gave consent to the event going ahead was that his holiday overseas was paid for. The event organiser has reneged on that. So I agree with the guy for wanting to get compensated. Lets face it theres no way an overseas company is gonna stump up after the event
legacy_girlz,

My only question is why did he wait until now to kick up a fuss! It has been common knowledge for a long time that this will be the final year for the event in Hamilton so why didn't he approach the promoters as soon as last years event finished. I think he has been more than adequately compensated in the past but should have followed up on it way sooner than a couple of weeks out from the event. All I can say is that IF he were successful in getting the event stopped, he better find somewhere to go & hide from the thousands of angry race fans!
