Hypothetical scenario - if you are sandwiched

at a light controlled intersection and shunted forward into the car in front it isn't your fault is it!It would be the car hitting from behind in the wrong wouldn't it!Just having a discussion and someone thought that the person in the middle being hit from behind would be liable for not stopping at a "safe distance"between cars.Thing is I don't remember ever hearing about a safe distance whilst stopped - while still mobile yes but not while stopped.

If you are stationary it is out of your control if you are hit and pushed into another car

I have heard the same, that each car is responsible for the one in front of it. I dont agree though!

the question the front car driver will be asked is how many hits they felt.1 or two.

Not liable no, a bit hard to prove sometimes though. Especially once the guy who hit you figures out that it would save him a bit if he made out you hit the car in front before he hit you.

One or two!How would that work!The car behind them gets hit then that car would hit them which would be one hit I would imagine. .how could there be two!

But if you were stopped at a set of lights how could you hit them first!Sorry not being picky just trying to work it out in my head lol.

This happened to me.I was stopped but with brakes off because we were just about to move. The fella behind came around the corner at warp factor nine and ploughed into my car. My car lunged forward and hit the ute in front which had a bullbar stepladder towbar huge construction of tube steel on it. The driver hopped out, had a quick look at his unmarked ute, my slightly crumply 3 series, a completely trashed celica which hit me, gave a little chuckle and said "see ya".

The dude that hit me strung me along with excuses for a couple of weeks and then skipped the country.

Awesome.

Thats the EXACT point. If you felt one hit then the rear car pushed the second car into the front car. If there were TWO bangs then the middle car hit the front car then the rear car hit the two cars. The police and insurers want to see if the middle car driver has any responsibility

That doesn't explain whether the 'middle' car hit the front car as a result of being hit or not!

Ahh I get what you mean - no in this hypothetical scenario both the front cars were at a complete stop and the one at the back was the one who started the whole thing by hitting the middle car first.It happened to a friend of mine - he was the middle car - and his car was written off a result.His insurance only paid out for HIS car which is why I am thinking the one in the middle has no liability for any damage to the front car.

Now if there was two thumps then both the back cars would be liable right!Both of them failed to stop safely therefore both in the wrong!

Not critiqueing your freind but it does amaze me how people are blissfully unaware of whats going on behind them when stopped at lights etc.
I guess being a biker means I'm always looking for trouble.

I agree.Also as a biker - a really good reason to filter to the front and wait alongside the first car.

You cant be held liable for the car in front if you are stopped. If there are 6 cars stopped and someone ploughs into the back one at 80kph and shunts them all forward, then only the rear one is to blame.
