the dealer told us it had been serviced, the car didnt come with the paperwork saying it had been serviced etc, can i still go back to the car sale yard now & ask for the recipts!

do not go to the dealer first! go straight to the insurance company, ifthe dealer has any liability at all you can be sure that the insurance company will get their pound of flesh. you paid good money for insurance and good on you for doing that, now its time to cash in on your investment. i would suggest ringing the insurance company first thing monday morning with a list of things that are wrong and take it from there. i woild suggest that you tell them you stopped driving it as soon as the symptoms were noticed good luck

What happened to the consumer gaurantees act! Just because the op has paid big money for a mechanical warranty, it does not mean the dealer can shirk away from his responsabilites They have just bought a car, and the transmission has just shit itself. Take it back to the dealer.

If the dealer is in any way liable then the insurance company will get every cent they are owed from the car dealer. therefore the integrity of the consumer guarentee act remains intact. if the op takes the car to the dealer and worst case scenario the dealer does something that voids the insurance then what! as some one else has mentioned the insurance company will do what they can to not pay. the correct course of action is to contact the insurance company first if they tell op to take car back to dealer first then all well and good.

It's a 13/14 year old vehicle, I'd be surprised if it had any more than 28 days on it, let alone 3 months. Old cars go wrong, at what point do you think it becomes the owners issue, and not the dealers 6months, 12 months.never.! They have insurance, I'd use it.

We brought a "low" km (55k) 2006 Honda oddy from shackle motors in lower hutt, after a couple months we stopped at lights, I put it in neurtral and that was the last time that transmission ever worked. no clunk or noise, warning of any sort or anything. Just a gearbox full of nothings. Was just a totally random failure.
Shackle sent a person with a car for us immediately and took care of everything.We hadn't brought a warrenty but they gave us a very nice car to use in the meantime and followed up afterwards.
Excellent service and shackle were just a pleasure to deal with.

fair enough, but i am thinking the op is more worried about getting a reliable vehicle for his/her young family than the ins and outs of the CGA.

That is the very WORST advice I have heard on here for a long time. OP contact the dealer right away. Tell him what has happened. You are covered twofold under the CGA and SOGA. First of all theres the dealerthen theres the garage that carried out the work on the car. YOU MUST contact the dealer before undertaking any workif you expect any payment from them for the mechanical failure.

Tigga you cannot put a time limit on the CGA. December 4th means its about 2.5 months since purchase so you are well covered by the CGA. If you were feeling charitable towards the dealer you might concider contacting them telling them you will take the car to XYZ transmission and that they are only to cover costs not covered by the warranty.This likely will be around $600 -The 250 excess and fluids etc. In your shoes though I'd be leaving that entirely in the dealers hands. Let them organise pickup ,dropoff to the transmission company and payment for excess etc.

I have heard of the dealer still claiming on the 3rd party warranty however they pay the excess, and I agree with go to dealer first.
