Plead not guilty and ask for it to be heard by a court of law. stating you want the officer and the complainant present, Do not write anything else when you send the letter.

its getting byond redicules facist poice state here. i left switzerland in the 90s because that gungester country is europes biggest police satate only austria tops switzerland for being a worse facist police state .
Germany on the other hand is way more professional where lawyers can be hired on the autobahn to find a flaw in the offence and the offence gets scraped instantly once you proof a flaw like road surface not up to standard in the distance your alegaded offence took place. Now thats not ideal but you have the right there at least to beat them at there own game as where in this other facist corrupd police states you have not much of a chance .

Cops in my town have only ever been pleasant, never had a bad dealign with a cop but I dont break the law so have no need to get pulled over and have to contest stupid driving

i find the cops in taumarunui plesant roadblock with my merc for booze at new years, and the cop looks at my road user and it was out, i said that cant be i just purchased 5000, He said i should check it as the miage might have slid it back under the old one when i have time.
So pulled over and yes turnes out i got milage and rego
these 2 lables are togather tear off told my dad to put it in he put it in but the milage was on the back of the rego lable.
Common sense by police seems to be used at times .

poster 1 you should be able to appeal the conviction, i was also accused of a traffic offence that i did not commit a few years ago, after kicking up a stink it was eventually dropped, no respect for the police left anymore especially after that bullshit campaign they tried over the holidays, surely you can appeal the conviction and write to the infringements office and ask for FULL DISCLOSURE OF THE ALLEGED OFFENCE INCLUDING THE OFFICERS HAND WRITTEN NOTES, it sounds like they are on shaky ground to me as its just hair say "he said she said sort of thing" so i doubt it can be proven, appeal on that basis alone don't lie down and take this shit. i sympathize with you on ACC currently fighting them after years of knee problems that still aren't right.

i cant wait untill you get a bullshit revenue ticket for something you haven't done, but you also wont have the balls to come on the MB and actually admit it, recording the convo is a very good idea as the moment you challenge the cops lie through their teeth to protect their own, thats how my charge was dropped as i told them later that i recorded the convo and this will go to court if it has to, they backed down, they are on a quota and are not out to help you anymore, soon the highway patrol will have mobile eftpos machines with a 10% discount for prompt payment.

Thanks, decided to let it go re ticket, run out of fight and saving energy for acc. Also it isn't recorded as a conviction because it was merely enforcing meant, or at least that's how I heard it. So no conviction recorded. But learnt lesson and hence the post here.

the point is poster 1 has BEEN ACCUSED OF SOMETHING HE HAS NOT DONE BY A BENT COP TRYING TO FILL HIS QUOTA so recording the convo will help a lot in court.

might i suggest a dash cam, bent cops lie, video cameras don't it sounds like bull shit that they can convict you because "they said so" with out seeing the alleged offence, if i were you i would appeal get full disclosure and have it heard in court again.

im thinking the same thing, no so called witness no case summons the dick head of a cop if you decide to appeal ruin his day have him recall all the facts and do not forget to demand full disclosure under the official information act, i have helped a few freinds get off trivial revenue rasing offences (like 108km/h in the Mckenzie Country straight road perfect day car had no cruise control 1998 BMW3 series so hardly dangerous at that speed) just by asking for full disclosure regarding quota numbers number of tickets officer had issued that day, radar information (confirms +/- 2kmh accuracy for the Stalker Dual DSR) etc etc and they dropped the ticket, basically what i am trying to say is don't lay down and take it its disgusting what this country has come to its going to end up like Victoria soon but at least even they have to have video proof to convict you and they can't do it on hair say, at least in NZ car enthusiasts can defend them selves with a radar detector.

Yep, he didn't know what IAM (institute advanced motorists) was and was confused when I said I am member having done my advanced stage test. This is based on British police driving and way in advance of anything they taught here till IAM opened in Nz. Most bike cops here have done it as they are enthusiasts.

I assume when you say you "got done" that you have received a ticket, and you genuinely didnt do the offence.

In that case I would defend it vigorously.

DON'T tell the police what you intend doing. Get disclosure, that's all.

In court deny the confession, point out you discussed only a different event not the one you were accused of. Ensure the police give you complete disclosure. Who complained, what they alleged, and so on. Copies of their statements. And be prepared to call them as witnesses.

said it better then i could, tamarillo just get disclosure under an official information act request it costs you nothing and if you are successful in court i would imagine your costs would be refunded, make sure you summons the officer who accused you too, the justice system is there for all of us, not just bent traffic cops with an axe to grind against anyone who commits the dreadful crime of driving and a quota to fill

http://www.police.govt.nz/contact-us/praise-and-complain tamarillo if i were you i would make a complaint about the officer online (his number will be on the ticket) and also appeal on the grounds that this is simply unfair and the officer is full of shit (well don't use those words exactly but you get my drift) even if you have paid the ticket if you are found not guilty they will have to withdraw the ticket and refund you, including court costs, also seriously consider investing in a good dash cam with GPS if you do a lot of driving like i do i think you will find they will think twice about making shit up if you have a camera rolling.

unfortunately we now live in a country where we can't trust the police as far as we can kick them, they are out for the most part to extort money out of motorists for trivial offences that DO NOT CONSTITUTE criminal behavior, i know there are still some good ones out there but lets face it most of them are long gone by now and have been pushed out by a corporate mentality that the police should run as a business and turn profit at the expense of anyone who dares to drive, hell they can't even keep to the traffic laws them selves and they expect everyone else to, I don't bloody think so
