Record conversation with officer next time.

I learnt a lesson today. If I am ever asked by an officer about an alleged incident I will record the conversation on smart phone, telling them of course. Or refuse to speak and ask for accusation in writing.

I just got done based on another driver's complaint. At a random checkpoint I was asked about an overtake 'about 20 mins ago' so I was honest and said yes I had passed a slow car with trailer and ATV, and a white SUV behind it, about 20 mins ago just out of Blenheim where there is big long straight and legal overtaking. We went over it time and time again, I even pointed out the trailer when it passed.
But in summons and complainants statement i am accused of passing a row of up to 6 cars (no trailer) across yellow lines just moment before Seddon checkpoint. This is a very different place than I discussed. 15-20 mins apart.
But officer denies everything I said and reckons i admitted it. He can't account for why i discussed the trailer and 20 mins ago, just that he thought I was confused. Didn't bother telling me at time though that I was talking about different incident altogether.
Im guilty based on another drivers complaint (they were behind me at checkpoint and complained). I can only assume I pissed them off passing them legally when they were too slow to bother themselves and maybe they got stuck behind trailer.
So, next time I will pull out smart phone out and record everything.

Be polite and give them your name and address as required but never admit anything. They aren't out to help you, they want a conviction.

Unless you are under arrest, I believe you only need to state your name, date of birth, address and occupation. Nothing else. No need to chit chat to an officer about anything whatsoever if you don't want to.

If you didn't do what is alleged, plead not guilty, have a hearing
and let the judge decide.

I did! Now i have to pay even more - the ticket (sent later) was only $150 but decided to defend on matter of principle. Cost me more!

Fair call, this dates back to July 2014 when i was working and reasonably healthy. That shows long it takes to get through system.
Before xmas i was laid off (again) as i do have long term health problem that was interfering with work too much. January 6th I was in a boat that had an accident (nothing to do with me) and made me even worse. Right now I am up and about again but limited, hence not working, hence bored! Driving a bit but not riding bike yet - too sore. I am waiting for an operation that it looks like I will have to pay for to get it done anytime soon.

I have a court hearing and the result of a formal complaint about an officer I made coming up. I stood up to him at the time (he had no good reason to charge me yet his driving was dangerous). He's put on his ticket notes that I was "abusive". Worth keeping the trap shut.

Thanks, yes i really NEED to be back on my bike. Will strap up my back, take some pain killers and head out for short ride this weekend - I really need it.
Thinking of trying crowd funding site to get some of the $16,000 ACC won't stump up - but that's a loooooong other story I won't bore with here.

I couldn't agree more tamarillo and have myself advised people on here before, record EVERY encounter with Police whether innocent or guilty including phone conversations.

It disgusts me that it has come to this in our beautiful country, it disgusts me even more that there are so many easily brainwashed "enablers" who just blindly defend the Police without actually knowing what's going on. It's THEM who are stopping the lid being lifted on the sad situation we have found ourselves in, and until things are exposed for what they are there is no hope for improving things. It's like trying to rehabilitate an alcoholic who won't admit they are an alcoholic.

Make sure you request all and any information you can think of before your court hearing. Make them work for their money and make sure absolutely everything they provide is in perfect order. Chances are they won't bother appearing. Best of luck with it.

tamarillo its :funny: you should say that. Mrs kaz has debilitating (at times) health issues that have been diagnosed by hospital doctors as "in her mind"
Turns out we were right all along --40 odd k in docs bills later we find out she has the exact same health issue her brother was diagnosed with 20 years ago.
we were almost screaming this at top of our lungs but NO they know better.

BTW. something else that really irks me is this "attitude test nonsense".

EVERYONE should be treated equally, and just because you don't want to boot lick and provide information that can be twisted and used against you is NO reason for you not to be treated as fairly as the next person.

This attitude test nonsense is just a scam to get people to smile politely while the cops have an easy job of "stitching you up" to put little ticks in their box's. They win either way.

The ONLY way we can change this is if people stand up and say enough is enough. The Police are NOT judge jury and executioner. Boot licking is NOT a requirement for fair and proper treatment. It needs to be called out for what it is, not what it masquerades as.

People need to remember they work for US, for the betterment of OUR community. WE pay their wages. It's absurd that people have become so manipulated in this country that the masses stamp on you for even bringing this up.

Not all of us have a cellphone (I've never had one) to record anything.

If you are a road user, it's time to think about getting one. Even a $10 dicta-phone in the glovebox will do. It's an investment that has a high chance of paying for itself many many times over.

Yes I do feel like that. Having been told that despite a clear injury the pain was chronic pain syndrome and spent 20 years of restricted activity and work, a new diagnostic procedure last year showed where nerve interference is and surgeon wants to operate. Ahhhgggggggg. But now acc say it's a different injury and I cant say when it was done so f*** off mate.
Then in boat I added a compound fracture, that wasn't there last year in MRi scan and is diagnosed as due to severe impact trauma which is what happened in boat. But acc won't honour that as they say it is part of old injury. I'll prove them wrong medically eventually but boy they wear you down. Hence I'm on solo parent dole as can't get acc but can't work. Not happy. Hence my frustration at today's court events I guess, just get fed up fighting for what is right.
Learnt my lesson though. Next time I'll shut up or record everything.

If you are recording the conversation between yourself and someone else, you don't need to tell them you are recording it. That's only if you are recoding a conversation between two other party's.

the person who complained will have to be in court to give evidence as well best to just deny deny deny in these situations. Innocent till proven guilty

no not really, JP decided to believe them not me and ignored evidence of officers confusion. Any point is, lesson learnt - don't speak without record or it can get twisted later. i was stupid to discuss accusation with him at the time.

And then this one time, a cop did a u turn in front of you, and another wouldn't let you drive a non warranted car and abused you on the phone for 'no reason', and you, only you have hidden information about many deaths caused by Police actions. play it again Jazz, thrilling.

I have philosophical reasons against them & the minuses outweight the pluses.
