My x partner hp a car the other day and used my address because the ownership papers turned up in my letterbox, she hasn't lived at my address for 2months, is this wrong?or fraud?

I'd say it's wrong but not sure if its fraud as who has been defrauded (disadvantaged) by the use of your address?
mrfxit,

Technically fraud.
False address on a legal document IS fraudulent Can make the whole deal invalid in court if proven deliberate.

Technically yes, it's fraudulent (misuse of a document to gain a financial advantage, i.e. declaring a false address to avoid scrutiny and / or failure to obtain finance because their actual current address disclosure would lead to finance being declined) but more importantly, it renders the finance contract void (by way of a false declaration) and the finance company, if aware, can exercise the right to immediately secure (ie repossess) the car without the usual notice period first, on the basis that (a) the contract is invalid, and (b) the secured item- the car- therefore in jeopardy.
The next call, is up to you.

She may want a reason to come around and see you again? You know . like get it on.

noswalg,

Are you opening her mail Pauly?

You cannot make anyone be a guarantor, they have to agree!

what to do,
tiny15,
May 11, 10:24am
she used your address so that when she defaults on the payments- the repo man will come to your place looking for the car
skin1235,
May 11, 10:31am
if the repo man you should be okay - he'll go away and note the car is no longer at your address, and start looking for it elsewhere if the bailiff you're in deep stoosh - he'll take your car and other gear to make up the balance of monies owed
talk to the ex, and if not welling to remedy the issue you need to inform the finance company of the error and the reluctance to remedy it

LOL, +1?

paulyboy- for a starter do you actually know its Hire Purchase? If it is HP then I would be concerned on a couple of fronts. 1)did she use your name as a reference of any sort? 2) does she have you as a co borrower 3) are you a homeowner and how does that affect the HP?
paulybboy,
May 11, 11:23am
I know its hp because she told me ,plus I went and asked the car sales man if she used my details,he reckon she cant, hed say any thing to sell a car
skin1235,
May 11, 11:28am
she's only been gone 2 months, must hurt that she can actually manage to buy a car without you being involved
just let her get on with her life, she's made the break, wish her well without trying to put a stick in her spokes
skin1235,
May 11, 11:32am
most self respecting men would now be finding a way to freehold it for her and if that cash wasn't available at least offering to meet her payments on it with an equal payment, so it is no longer a burden to her
or leave it to bitterness and lawyers and have the house sold so you both end up with SWA, no cars and no home
myrns,

Aye. good point! Maybe op Is just pissed that his ex can get along just fine without him and can buy a car without saying 'no' all the time. she is probably glad to get away from the control freak?

Man this place is getting nastier by the day, and it's only going to get worse as not many decent posters want to put up with these sorts of nasty and unwarranted personal attacks.
The man asked a reasonable question, sure point out he probably shouldn't have opened her mail. But no need to get all caustic about a situation we know nothing about.

Fixed it for ya ^ ^^ ;-)

Agreed. Could be very lucky for him that he DID open the letter.

I gave her 7 grand to get a car and set her self up, but when you have shit credit rating all your life makes it hard for them

If one has 7K to spend on a car, one doesn't need HP. Just buy it. ?
cagivachick1,
May 11, 6:03pm
unles of course the car she wants is more than 7k
skin1235,
May 11, 6:45pm
yeah sorry jazz, dealing with life at this end, a little different to screen life, daughter just had her car destroyed by an ex - it must have been too nice for her to drive in, plus it was her only means of escape from the turmoil at her house, now she cannot leave when she needs too and has to stay put and 'put up' with his behaviour whenever he decides to return for a few days, plus with the added that if she tries to leave she'll get worse than the car got ! he's not worth doing time for but if I were diagnosed with terminal cancer tomorrow he'd be in the ground within a week

how magnanimous of you, 7k you maybe the nicest guy in the world but your posts are not telling the whole story, you're still trying one-upsmanship and wanting us to think you're a grand chappie( giving her 7k and then mentioning her credit rating - which as her partner you could have remedied )the story they do tell is controlled, and doled out bit by bit in an attempt to realign the thoughts with your impression of what a good chappie you are
Jazz's comment is fair enough - face value it maybe a bit mean to question, my first post was along those lines, your reply with the next installment told me you are a controller, you've come on here to gather support, you went to see the salesman but he wouldn't give you the ammo you required a pretty dark picture forms
