something I have wondered for a while,Driving along in a 100 kph zone and you come up behind a tractor and now there are double yellow lines or even a single on yr side and tractors only doing 40ks are you allowed to pass it. I see it probably at least 4 or 5 times a week and people fly past them.

next Question open road 100 kph zone and next thing theres a country school with the school zone signs out do you have to slow to 40 kph here also there again no one does but what would the law say wonder

nick91111, Dec 3, 7:32pm
1.) No. But as you say people do. 2.)Yes you must slow.

intrade, Dec 3, 8:34pm
dont worry there wont be any speed cameras near schools the speedcameras are where they get the most revenue like on the motorway or places where any normal person would go to fast because there is no danger.
its not about saving lives its how to milk everyone dry the most easy way .

tamarillo, Dec 3, 8:38pm
This. Plus if there is a school bus stopped you must slow to 20 to pass it.

poppajn, Dec 3, 8:38pm
This, (1) you can only pass on a yellow if you stay inside the lane on your side.
(2) As posted.

pico42, Dec 3, 11:20pm
1) You can still overtake, but cannot cross the yellow line in doing so. Which usually means you effective,y cannot overtake.
2) School zone signs on their own do not require a reduction in speed. Only if the school zone sign includes a speed limit sign. In which case you would adjust your speed to be no lore than that posted on the sign.

stevo2, Dec 4, 4:10am
Correct.
This is the law.
Now who here never breaks it?
Number 1 or number 2.
Personally Im pretty good on my speed while passing a school but have been known to put 2 wheels over the yellow line overtaking the many tractors on our highways in the BoP BUT only when there is clear visibility (which is pretty easy when the tractors doing 30kph)

tats63, Dec 4, 4:42am
You could substitute tractor for gaggle (? Flock/herd? ) of cyclists. Same issue with yellow lines.
In a similar vane if you are on your motorbike do yo pass said tractor (cyclists) closely to stay inside yellow lines or take a safer line with a quick cross over the yellows (obviously with full visibility throughout).

Well, now, that is so funny I couldn't help responding. We have a neighbour who was "pinged" by a speed camera four times in the same day for speeding past one of the local schools. Four times! Every one around here recognise the local speed camera vehicles and see them often. She has been moaning about how unfair it all is and she was driving carefully and that the speed limit is ridiculous for her as she is a very experienced and careful driver. My wife (who can be rather blunt at times) told her to go away and try growing up. that she is an idiot. So don't speed around schools seems to be the answer!

poppajn, Dec 4, 7:59am
As someone who has taken a child's life (not my fault) I cannot agree more.

elect70, Dec 4, 2:13pm
had 1 down here in a van parked just up from local college normally 50 k . bet he got plenty .

msigg, Dec 4, 3:29pm
Yes stevo you are correct, those yellow lines are not supposed to be crossed, but if the tractor is going slow enough and you have clear visability then I would do it, the roads are engineered for 100km and the double yellow lines are because at that speed you can't have enough visibility, if the speed is dropped so much that there is plenty of clear road then go for it, the chances of a cop seeing this at the same time is very slim, they could give you a ticket but may accept it as well, just that if you do it once don't come complacent and do it in other area. i know you don't. all good.

xs1100, Dec 4, 3:30pm
I think you will find that a school zone indicates its a 40kph area with a 5 kph tolerance between 7.45-9.15 and 2.30-4.45

tony9, Dec 4, 3:35pm
You are thinking the wrong way around. Not only is it the oncoming traffic which had reduced visibility (the reason for the double yellow lines) but it is likely you will still be accelerating at a relatively low speed as you pass so you will be on the wrong side of the road for longer.

purplegoat, Dec 4, 3:38pm
I disagree with your logic on this one . If you are behind a tractor doing 30 and there's yellow lines the oncoming traffic will still be doing 100 so will " appear from nowhere " our of that dip or over the brow of the hill in exactly the same time frame as if you were doing 100 . Personally I think the danger is significantly heightened because you are coming form a low speed the actual time to complete the manoeuvre will be considerably longer
Double yellow lines are there for a reason, regardless of what speed you are travelling at

henderson_guy, Dec 4, 3:40pm
I think you will find that you are wrong.

lookoutas, Dec 4, 4:28pm
There's a lot of thinking going on here.
xs1100 is 'yeah nah' The speed past a school is whatever it's signposted at, but they do run at clitty's favourite 4K tolerance within 1 hour of school hours.
That means if they put a camera outside a school, you will get pinged for 5K over within those times.

henderson_guy, Dec 4, 4:37pm
Nah, it's 5km tolerance within 250mm of a school, regardless of time of day (or night)

wind.turbine, Dec 4, 4:50pm
do not pass a tractor on a yellow line!
or around a corner for that matter!

lots of people think that just because tractors are big that they wont get effected when in a crash so seem to take risks around them.
but its the complete opposite, if you cut off a tractor and cause them to go off the road, it normally ends on its side and most likely killing the driver, also if you hit one, even just clipping it will likely cause it to spin out and flip.

This is what should all be in the road code as in nz you are likely to come across tractors many times in your driving life and people just don't seem to know how to drive around tractors. and by around im not meaning passing

bigmuz1, Dec 4, 4:54pm
250mm, wouldn't leave much room to set up a camera.

purplegoat, Dec 4, 5:01pm
My observation in the 70-80k of mileage I do on SH annually in lower north island is that the worst offenders for dangerous passing of a tractor or other slow moving object are the clowns who dawdle along at 90 oblivious to the line up behind them

tamarillo, Dec 4, 5:12pm
You've really done it now. Here comes clatty.

1 Purpose
40km/h variable speed limits in school zones have been operating successfully in New Zealand since
they were first installed on a trial basis in Christchurch in January 2000. In April 2011 the NZ Transport
Agency (NZTA) revised the conditions of approval to give road controlling authorities more flexibility to
install these speed limits at both urban and rural schools.

xs1100, Dec 4, 5:33pm
Land Transport Rule: Setting of Speed Limits 2003 requires the NZTA to approve a variable speed limit
before a road controlling authority can make a bylaw to set such a speed limit. For 40km/h variable
speed limits in school zones, the NZTA has published a revised notice in the New Zealand Gazette1 (the
Gazette) which approves those speed limits, sets out appropriate conditions and authorises road
controlling authorities to set them. This traffic note provides guidelines to comply with the Gazette
notice, based on the results of the trials in Christchurch and subsequent experience with these speed
limits. Recommendations for installing variable speed limits at rural schools are also included in this
traffic note.

skin1235, Dec 4, 5:55pm
my stepdad got a ticket for exactly that xs, the cop was behind him, no oncoming traffic, dad pulled out and passed the tractor, the cop waited until the yellow line ended then gave chase, $200 for inconsiderate / dangerous driving

my pet hate at the moment is fools who will not pass my tractor when the yellow line is on the other side of the road - we have several areas down here where the lines are quite long, perhaps 1km on each side of one particular hill, and only double for about 200mts in the middle, fools still tuck up under my back wheels gesturing madly for as long as there is a yellow streak anywhere in sight, then the 12 cars behind them all have a toot and single finger wave as they go by too, like farrk, is it my fault you don't know that you are allowed to cross the yellow line if its on the other side of the road
