Got stopped by a cop today.

Got caught on waiting for a oncoming car to go past so that I can turn Right into a side road (where a cop was waiting to turn out of) and when the on coming car decided to turn Left and waited for me to 1st, I took the turn.

I had been sitting waiting for more than 20 seconds, and thought all was good, so after half a Km down the road I was stopped by the cop that saw everything.

If the other guy that was on coming traffic was had NOT stopped all would of been fine, BUT as they stopped and waited for me I was in the wrong.

That's NOT right or fair.

To top it all off, I was with my girlfriend and driving her car, so He asked if it was my car. She piped up it's my car.
He said yes *her name* why the hell ask if he knows that already?

Talk about looking for work, why the hell don't they go and police the areas the local cops don't care and crime is high?

That's pretty gay.
I get this situation too with people forgetting that rule, but what I do is just sit there with a grumpy look on my face waiting until they just go. If they signal for me to go I shake my head, it works.

In Morrinsville yesterday I had the same thing happen while turning right a woman turning left sat there . So did I ,,my wife then says what the f---- are you doing?. I stuck it out and won.Also today Piako Rd suddenly found myself doing 100k on a short 50k road works section nobody there but the policeman just up the road was busy! Don't feel bad bug

I still want to know WHY he asked if it was my car.

If he already knew that detail.

They compare the details. Theres no reason for them to believe you.
If you bothered looking, as a car driver, you must tell them the owner of the cars name and their address, or how to get there or such.

Otherwise you must give them 'your name] age or date of birth, address and occupation (but you don't have to tell them who you work for) .

This is all obvious to me.
I don't know why you are making such a big deal about it.

(I have a funny story about this but its not the right time or thread)

You broke a traffic law (which is understandable if the other driver waved you on). Police caught you. They made a cursory verbal check to ensure the car wasn't stolen. and you complain?

I don't get it. What if it was your car and was being driven by a thief?

For goodness sake. Why on earth would showing a bit of courtesy or taking advantage of a bit of courtesy be against the law?

I routinely give way to other traffic in all sorts of scenarios and one of those is allowing someone to make a right turn across my bows, as on many roads, that right turner is holding up traffic behind them, so to not let them across is just dumb and what sets kiwi drivers up as inconsiderate.

I certainly wasn't aware that it was in any way illegal. Did some law get passed that when they abolished the stupid give way to the right rule, it was then made illegal? If so, it definitely didn't get publicised.

Sorry mr lovebug Im not reading anything nasty or unwarranted in the cops actions.
Either you were soposed to give way to straight through traffic or give way to left turn traffic. those are the road rules.
The other stuff is all about ensuring you were legally and rightfully driving the car.

One would think that a requirement to 'give way' could be overruled if there is clear agreement by both parties? I.e. a transfer of right of way.

Coming out of a private driveway in peak Auckland traffic, it would often be impossible to get into the traffic stream if it wasn't for some courteous driver who holds back and waves you in. I guess we now have to make sure there isn't a cop watching before taking advantage. Come to think of it, I recently remained stationary at an intersection to allow a cop car exit a parking space on my left. He seemed to have no qualms about breaking the law and accepting my courtesy.

He was.
He checked to see if there were any outstanding issues regarding the car. ( registration, wof)
Checked to see if the numberplate matched the car description
He checked to see if the car was not being driven without the owners knowledge.
He checked to see if there was anything unusual in the interior of the car
He checked for any signs of drinking or drug impairment.

Not all drivers are crooks, but all crooks are drivers.

Simple answer OP. At the top left of the ticket you will find the police infringement bureau details. Write a letter explaining the situation and an adjudicator may (stress the may) agree with your side of events and quash the ticket. Have seen plenty of people successfully get off when they have explained how things happened (contrary to what some will post here). Worth a crack

I don't think you did break the law.

You are allowed to turn in front of a left turning car, if you have time to complete the manoeuvre safely before the left turning car enters the intersection.

Which clearly you did.

Don't explain it to the police - its just informing them of your defence.

Take it to court.

Explain it to the court. In my experience, the police will bail out at the last minute. Even if they don't, the JP or judge is very likely to agree with you.

Oh, I must remember that, I am sure that the public give honest and straight forward answers to police when they are trying to sort out what actually happened, and the police should always accept that as fact. :)
