Dodgy seller

Hi all,
Well more issues with the car i got. After taking the car to a mechanic i found that the cambelt had not been done as stated in the auction.I rang the dealer who the seller purchased it from - He advised me that the seller contacted him early last week, and the dealer told him it had not been done.
I know the car was sold out of TM, but is there any fall back for me as he obviously lied.

Yes he stated in the auction twice.One in the ad and one in the questions.

Buyer beware. Its got nothing to do with the dealer. Just bite the bullet and pay for it.

I have no issue with the dealer.
The seller is a different story.He stated multiple times that it was done.
Would i win this in small claims court!Its $1200 odd that i shouldnt have to spend.

Chalk it up to experence. Not worry the diesel chasing someone for a grand. Even if you win at the small claims or whatever they call it, they probably dont have the dosh.
People lie. You need any claims in writing eg receipts for the work, or checking the service manual (if it exists).

If he has written it in the auction AND in the Q&A section, there's your proof right there. You also have the dealer saying it was never done. Take his ass to small claims court. Too many people get away with this BS.

If O/P was lied to and can prove it, he has a claim against seller. Disputes tribunal is a very simple process to follow. Your comments just stoopid!.

dont let this lie. The disputes tribunal / small claims court is a very very simple process to go through. With that comment on the auction you'll win hands down if the cambelt has not been done. Go in tomorrow and file a claim. It really is simple!

How do you know he didn't contact the previous owner and they said it had been done. The dealer only had it for two weeks & that was at 97000kms. So the dealer obviously didn't have it done. 95000kms was when the previous owner had it. Just a cambelt by itself would only cost $300.00 or so and if you take it to small claims that is all you will get. The figures you are quoting are from a franchise, that will replace everything, seals, waterpump, tensioners at huge hourly rate.Cambelt only was ever mentioned.
Nothing like a clairvoyant mechanic who can just say it hasn't been done. LOL.
Man I am glad you didn't buy my car now, but I can tell you the new owner is over the moon, with his sweet sounding V8 Fairmont Ghia I sold him.
If you can't get a cambelt & other stuff done for under $700.00 you are being ripped.
Oh enjoy your new weekend driver, the previous owner did, but only for 5 months, that should have rung a bell or 3 or 4.

As far as I am aware a proper cambelt done on a quadcam boxer turbo can't be done for under $800 - if it did I certainly wouldn't go there as there will be corners cut big time.

correct. and if he says "the previous owner told me they did it" then he may have to pay the OP then take the previous owner to small claims if he wishes.
You cannot blatently lie to misrepresent a buyer.

Wow. Personal attacks - that is low. This teacher obviously knows more than you about Subaru cambelts or are you the type of 'mechanic' that ignores seals and waterpumps!

I had some respect for your postings on here but I can see that was misplaced.

This primary school teacher has also changed cambelts, cv's and other basic tasks on a few different makes of cars and has also recently built a 3bdrm house.

But because I am a teacher I know only that profession!

I am not resentful, I got the price I was asking plus a trade I have already sold. So no, I am fine. But you need to check the stuff out I mentioned above. Cambelt only was mentioned, none of the other stuff, so a cambelt only is the best you will get. Fact. How do you know a friend of the previous previous owner didn't replace it for the cost of a cambelt and a box of Tui. You just don't know. You are better off just to get it done and call it a life experience.

eke690 No I am not a mechanic, but I do many cambelts on my cars at the request of my customers, then pass on the cost price to me to the customer. So yes I do know how much a cambelt and other stuff costs, it is my job. Sorry if I offended you but I am in the industry. If it would cost you $800.00, that is fine, it is still way cheaper than the $1000.00 to $1200.00 that was being tossed around before. It was you who said I was wrong to start with.
But lets remain friends over a $100.00 difference on a message board.

why would the o/p want to give the disputes tribunal a miss.
It's so easy, its stupid not to go ahead with it.I could understand your comment if it was a major and took time or energy away from other stuff they were doing, but its so simple, anyone with a good claim would be foolish not to follow through with it. Can I suggest, it's not about the money, it's about being lied too.

As for the price of the job, that will come down to the quotes the O/P gets to do the job.
