And if you dont replace worn or damaged faulty parts during the cambelt change what happens! What's the point of doing a cambelt change if the idler and tensioner are totally stuffed. One could say, they must be replaced as part of the job.

Mechanic has just called to say none of the parts have been replaced. Thanks to Carjam i also have the guys full name, but not address or land line number - just cellphone. But its a good start. Oh and he's not listed in the phonebook.

Have contacted tradme - need the disputes tribunal to sign a form - will do this afternoon. Seller contacted me (text) saying he will put $70 across for rego only. Just txt me saying he will pay it but wouldnt have sold it for such a low price if it had been done! WTF - he said it was done.
Hopefully get some money in my bank today.

Sorry I thought small claims was a massive amount of screwing around for little outcome, thats why i told him not to bother. but from the look of it i was mistaken. Good luck hydro, hang the filthy sod out to dry, especially now after he text you about him selling it cheaper because of belt not being done

The big problem is that even if he can't prove it was done you would have to prove it wasn't done. I habn't read this whole thing so maybe its already been said but you could try phonening some of the sabaru dealers to see if they have any records.

Have asked trademe for his details - form sent this afternoon signed by JP at court house.Apparently my waterpump was leaking, and nothing had ever been replaced.Cost me just over $1,000.00. Havent heard anymore from seller. Have to wait till TM provides me his address before the disputes tribunal will even look at me.

did you get the car checked out before you bought it! or did you just take his word for it!
hydroman08,
Feb 11, 4:26pm
Stupidly i took his word for it.I looked over the car myself before i handed over the cash, but i couldnt see the cambelt etc.Learned my lesson there.Although in my defense he did state he would provide proof of cambelt being done and that his mechanic had checked the car over less than a month ago with no faults.

oh, ok
hydroman08,

I've learned my lesson not to trust people when it comes to this sort of thing.A pretty expensive lesson it has turned out to be - I'm pretty sure the disputes tribunal will see it as i do in that he blatantly lied in the auction, and he knew it had not been done.

UPDATE
Got money from the seller today. Obviously the threat of small claims court and the fact they knew they were in the wrong helped their decision. Thanks for all the support :)
