I realise this is an old thread, but wanted to ask supernova2, do writing to the Police Comlaint works and would not getting with the coppers more trouble! My son has a similar case which the cops called him up days later saying that someone saw him do a burnout. Case was postsponed a few times and later dropped. But by this time he has to be off work to attend the hearing (which was then postsponed) and had to pay impounded fees.I am thinking of making a complain to the Police Complaints as this is day light robbery.

I have a query re loss of traction. Son had a bunch of friends for visit from a town 9 hrs away to pick up a car 1 had bought, they went to beach for a drive in 3 cars to check out car before driving 9hrs home as bought sight unseen. someone complains about them. (this is a beach you are allowed to drive on) they got done for sustained loss of traction on way back from beach. cop never saw anything just going on complaint so all 3 cars impounded. what proof does the cop need! all 12 young people drove but just 3 being charged as the cars belong to them so driving charges all blamed on them. would this stand in court!

Despite Bikerboys clouded and distorted comment, of course they will need evidence to prove the case, but it may find out what evidence they have before judging, how many witnesses!, did they admit it! etc etc.

I wasn`t afforded the same courtesy unfortunately and was faced with exactly that. Took 12 months to get to a defended hearing, I represented myself and won, not that I didn`t expect to, its not hard to beat idiots at their own game. 15 months further on still trying to get my money back, thats a battle in itself, they don`t like being portrayed as losers, even when they are. Not giving up on it .

Dead right,I live by the following mantra when it comes to the police : Never accompany. Never give a statement. Never allow notes to be taken. (They have to ask, and can be produced in court). Never answer questions. (Apart from your name and address). Never plead guilty. (Even if you are. You can change your plea at a later date, once you`ve caused the maximum waste of time for the maximum amount of policemen by having them prepare a defended hearing. If you`re brave enough on the day of the hearing is best, it means that policemen giving evidence have to be in court, and hopefully supposed to be on a day off, or annual leave . though I tend to do it the day before so it doesn`t appear so contrived .
And don`t feel sorry for them and say they are just doing their job, a lot of them simply have no idea what they`re supposed to be doing, and most of them couldn`t lie straight in bed. They certainly aren`tclever enough to lie in court without getting caught out ! Idiots.

If you are going to write in write in immediately.They have it sewn up nicely in that the address is a P.O Box so you can't courier to it. So what they do is throw out anything received in the last 10 days of the notice period and say that it didn't arrive on time.
Once they do that there is absolutely Zero recourse, you can't request a hearing if its a fine there is no way out. Its a nasty and very open abuse of power that needs to be stopped.

Ha ha . no, but thats because if you change your plea to guilty you don`t have to attend . I`ve pleaded not guilty to speed camera fines twice just to make an arse of myself, then changed my plea. The fine including court costs was less than the instant fine . No convictions (apart from speeding ones, and they don`t count) since 77 .
But but officer it's a tractor, tractors can't do what you accuse me off.

It's why you see so many assault on an officer cases cause they antagonise but can't take what they are dealt. If a cop was being a douche to me for no reason on a night out of course I'd hit him square in the nose. Half the time they need to call a taxi or the girlfriend to come pick up but they prefer public disorder fines and winding people up.
I wouldn't actually mind a stint as an officer just for something different but the way it's structured and how the focus is all wrong I won't go near it. It is basically a glorified tax accountant that issues tickets.

You are a buffoon of course a cop can take notes without permission, they might ask you to sign them, which you dont have to, but they can take as many notes as they please whether you like it or not. And about changing your plea the day before, if you do that and the evidence is overwelming your sentence will be tougher. And as far as never give a statement, if thats what is going to ensure they know you didnt do it, then of course you should, otherwise they will just have to act on what they know and have been provided by others.dont forget though.they are always watching.they have implanted microphones and cameras everywhere.be very very careful what you say out loud.

They are not paid to 'take what they have been dealt', its not a competition.They are also not social workers there to make sure you get home OK after making a dick of yourself. Would you like to make a statement in regards to (insert incident here) . No, thank you. Well, is it OK if I take notes while I talk to you ! No, you may not. Do you have anything to say in regards to (insert incident here) . No, thank you Constable. Goodbye.
The reason they have to ask is because the notes can be used in evidence. While theres nothing to stop a policeman making notes after he`s been shown the door there is a lot to be gained in not allowing him to do it at the time. Last "incident" for me the policeman managed to write the time of it in his notebook one hour wrong, then lied about it in court, it wasn`t hard for me to notice, but it obviously was for the ten or so policemen whose time I wasted for the defended hearing. Idiots. He admitted he hadn`t written up the notes for a couple of hours after . Bingo, not guilty thank you.
Re plea changing : only done it for speeding offences where there are statuatory maximum penalties. Never had one that was more than the instant fine, including court costs. Two have been less. The judge doesn`t care.

I have many friends and acquaintances in the police and the highway patrol. They share the disdain felt by the public to many of their colleagues, with good reason. Disturbingly I was told the other day that police are being taught two things currently as a result of the perceived high level of assaults on them : 1. If there is any suspicion at all that a situation is going to deteriorate, hit first, and hit hard. Let the judge sort it out, but just make sure you get your story right. 2. Forget about your powers of discretion, and anything you were taught about resolving issues. Lock them all up, and let the judge sort it out. This is being given as a reason for the shambles that is our court system, and the reason why there are so many defended hearings the police can`t possibly win, they don`t care.
So you may as well make it worth it and give them a decent crack if you get the chance, they`re going to do it to you anyway .

It's nothing to do with ones that make dicks of themselves it is ones that say have someone start a fight with them break away then the officer tries to issue a ticket to them as well then wonder why the person becomes defensive then aggressive. Half of them can't handle a situation right to save themselves, tickets don't fix it just separate and send people home bar the instigator(s) who can be dealt with dependant on what they did.
I've been in a bar and 2 people talking suddenly without warning started throwing, tables knocked over and glass everywhere. Then the barman looks at me to pay when I was at the table next to them, what fun dealing with dickhead officers just cause you had a night out somewhere -_-

Cops misquote laws all the time and kinda just expect you not to know what their on about and accept it's legit. Had a friend that got charged with basically made up bullshit and it took 3 months to fight it but he wrote to wellington like every week and in the end landed up getting compensation for lost time, he was threatening court action so they just coughed up some dough. Sometimes it's nice to know your way round things better than they do.
