Really makes you think doesnt it!
Charged for careless use of a motor vehicle causing death!
the car was parked and not moving!
I can see heaps of senarios where a cyclst could be put off course by all sorts of obstacles, people crossing the road etc.
Its a pretty genuine mistake i feel, and what if it was your kids in the back seat who opened the door! Who would be charged then!
bit of a loophole in the law if you ask me, just because it was a car door that was involved, the same charges would not apply if someone walking across the road stepped in front of the cyclist.
really sad story either was as someone was killed, i thought that would of been bad enough for the driver to go through having to live with that for the rest of their lives, without anymore punishment.

as far as im concerned there is not enough cycle lanes, and is just one reason i would never ride a bike myself, i dont enjoy it, i dont feel safe.
They know the risks, its more dangerous than in a car.
Sometimes ive been pushed off the road by cyclists, we are supposed to be 1.5m clear of a cyclist, but thats impossible sometimes, and have been forced to cross the centre line around a sharp bend, i could of hit oncoming traffic!
it works both ways.

There sure is but morons can't use it, while I feel sorry for this guy the cyclist is a major douche also. If you have access to a cycle lane use it, its like the lyra riders out westy west with the road just wide enough for the car. Then having to pass cyclists with this 1.5m crap, when the road is just wide enough to be on and pass with on coming traffic. So faults on both sides.

Another issue is visibility, its not always easy to see oncoming cyclists, as they are so small compared to cars.
The driver obviously genuinely did not see the cyclist coming.
perhaps Hi-Vis gear should be compulsory for cyclists, i commend those that already do, as it makes them much more visible.
OSH requires road workers etc to have Hi-Vis gear near roads, as they could be hit by a car if they are not seen, same could be said with cyclists.

interesting thing you mention there is a cycle lane there, because the media were talking about there wasnt any cycleway there, or perhaps it was not wide enough!

! Its impossible to ride a road bike on the designated cycle lane on Tamaki Drive! I think not, I've been on it plenty of times and don't see how difficult it is. Perhaps if people aren't able to even ride on a cycle lane comfortably they shouldn't be on the road.

If you have no choice of a cycle lane however, then fair enough ride on the road. Just don't weave and sit in the middle and cut through red lights like a plonker.

As woody 1946 said mirrors for bicycles / it used to be the rule that you had to have bells or a bulb horn on your bike / and no im not anti bike / i got bowled off my scooter 3 weeks ago . and i havent been back on it again yet .

Be ready for the unexpected - ride defensively. The most common mistakes people driving cars, trucks or buses, make are:

* not giving way
* passing you and then turning left straight in front of you
* coming from the opposite direction and turning right in front of you
* driving too close to you when they are overtaking
* opening their doors wide enough to hit you when you are cycling past
* not checking properly before coming out of driveways or parking places
* cutting corners
* driving too fast for the conditions
* trying to be nice by letting you turn at times when it's not necessarily safe for you to make the turn. If this happens don't make a move until you can see that the way is clear in all the lanes you need to cross. Wave them on if you want to.

In my opinion, the parked car driver, the now deceased cyclist and the truck driver should all share the blame of that incident.

1. the parked car driver should have looked before opening their door.
2. the cyclist should have ridden out in the lane away from the door opening distance.
3. the truck driver should have slowed down and kept his distance behind the cyclist until there was enough room to safely pass.

I too ride motorcycles, bicycles, drive cars and trucks.

Also, hindsight is a wonderful thing after the fact.

There was a cycle lane on the other side of the car. Oh did I say cycle lane. End of story. If I parked next to a cycle lane which is on my left, would I expect a cycle on my right!

It is legal to ride a bike on the road on Tamaki Drive.
It is illegal to open a car door to a cyclist.
The driver has been charged and I hope the charges stick ??
