I don't really want a refund.

Bought a ladder off here a couple of months back and now I've been notified by both TradeMe and Consumer Affairs that the ladder has been deemed unsafe because somebody injured themself with one and it was found the ladders don;t comply with whatever regs govt has in place. The dealer has been in contact and will refund my money.
Problem, I don't want a refund. When I bought it I was fully aware that it wasn't going to be something NASA would have been proud to build and the claimed 150KG load (horizontal) was obviously bullshit and if I could use it accordingly there shouldn't be any problems.
It was so damned CHEAP you see, I'll never buy another one with the refund money. I think I'll just keep it and see what happens.

Do the paper work keep the bureauats happy make it look like you care .keep the goods. .if you leave it then you will be pestered for life

neville48, May 6, 8:11pm
If you have an accident with that ladder being involved after you have been notified it doesn't comply you may not get ACC if needed ! Just a thought.

quater, May 6, 8:14pm
No one has ever asked me if whatever I hurt myself on complied, Maybe if I killed myself.

rob_man, May 6, 8:24pm
Compliant or not, it's a lot safer than the old ladder I've got.
And if ACC will pay out for a burglar who fell off a building then I can't see too many problems from that direction.

a.woodrow, May 6, 8:26pm
Keep it. The governement don't own your stuff.

tonyrockyhorror, May 6, 9:14pm
Pretend it was destroyed and keep it.

pollymay, May 6, 11:24pm
Keep it, if you have the common sense to see it's limitations you are ahead of 99% of the population.

pico42, May 7, 3:08am
Have they asked for the ladder back as part of the refund!

In any case, they can't force you to part with your property.

stevo2, May 7, 4:01am
Keep it but dont let anyone else use it.

smac, May 7, 5:48am
Nope. If I balance a stupidly rotten board on a tree that's too small, put on my inline skates and try and do a dismount any 12 year Romanian girl would be proud of, I'll still get ACC.

gusthe1, May 7, 5:53am
Did you try that tooo!

n1smo_gtir, May 7, 11:32am
just pretend you were on holiday at the time of the notice and was not aware of it.

rob_man, May 7, 11:38am
Already replied to their emails and asked if they could just replace it but they don't have any product to suit (read cheap enough) a swap.
Nah bugger it, I'll just return their pre-paid courier ticket when it arrives, with a note saying I'm keeping the ladder thanks.

bellky, May 7, 11:38am
Sounds ok.

elect70, May 7, 12:14pm
Probably safer than a lot of old laddersstill in use thatnever had anysaftey standard to comply with.

smac, May 7, 12:18pm
Yeah went through through the top rung on my pa's old wooden extension ladder while about 5m up. Luckily I had it at just a stupidly steep angle my foot simply landed on the next rung down.

neville48, May 7, 5:41pm
Ahh yes but if you do that and juggle revving chainsaws at the same time and one chainsaw does not have a chain brake you may be at risk of not getting ACC.

3tomany, May 7, 5:47pm
if you want an unsafe ladder to return i can give you one and then you can keep youres

zephyrheaven, May 7, 6:08pm
Only loophole I see here is : Rob's super sexy neighbour comes over while he is out (she has the keys to his man cave) borrows said ladder to install her new stripper practice pole on the verandah - ladder collapses trapping her 44DD's & pops the implants.

Now who's paying for Darlene's implant repairs!

urbanrefugee54, May 7, 6:10pm
if you have an accident with a chainsaw - they don't ask if it had a chain break. however [been there & done that]. if it is a workplace accident, it's a whole different kettle of rules. did you say it's for home use. I think I remember that plasterers aren't allowed to straddle the ladders that they used to be allowed to use & can't remember if the article said that they had to use a 2 step instead of a 3 step or visa versa - plasterers said that having to have one hand on the ladder at all times is impossible & the ladder they now have to use - doesn't work.

Years ago I owned a cheap & cheerful bicycle which I bought new and was subsequently recalled for a "Safety Issue".Like OP I didn't really want a refund.I rang the distributor to ask what the problem was and the answer was that two of the nuts didn't have lock washers installed. So I just went to Mitre 10 and got a couple of lock washers. The guy couldn't even be bothered looking up the code for them."Is that all you want!"Yeah."Off you go."

Win.

Depending on which bit of the ladder doesn't meet standards perhaps it could be modded to be safe!

bellky, May 8, 7:21am
We've got one like that. It's useless, (too loose in the joins) we've left it under the trees to rot - only problem is it's ali and won't lol.

rob_man, May 8, 8:06am
This one is slightly sloppy in the joints but not alarmingly so. It will no doubt get worse with age but for now it's priceless.
