Gosh alot of messages on checking back in.I have just had trademe send me a copy of the classified where it states "that both the engine and gearbox are in excellent condition"I feel this could be used under the contractual remedies act.This is him saying in writing that it is in excellent condition and it is not.I just think bugger it I'm not letting him get away with this.Even if I have to fix it myself he needs to be held responsible.

Lifes full of dissapointments, you have a long way to go.Expect every seller of anything to lie about the conditionunless they haveproof . . First car I bought off a dealer when i was an apprentice, bought on tick,wascrapyet he said engine had been reconditioned,butaftermonth itdiedengine wastired & even had some scond hand parts fitted . Dealershowed me the door when confronted .Put it down to experiance .

And an itemised invoice at that, its common sense to ask to see these things in order to back up claims made by sellers, especially claims that really made you decide you wanted to proceed with the sale.Sounds like the OP is a bit green TBH, anyone who's done any prior research with that amazing tool called TradeMe will see that most of these RVR's being dumped on the market are past their use by date, if its not bad engine oil leaks its blown HG's and/or cracked heads and/or engine smoke, if its not dodgy transmissions or transfer cases its terminal roof rust, etc etc. Its the same to a lesser extent with those old Toyota Estima Eminas.They all get chucked because they are costing or are about to cost money that the owner doesn't have and certainly won't get back.if they do spend it.

That is correct. So therefore there are grounds to register a dispute. The arbitrator finds in Sully's favour. We then encounter the old 'blood out of a stone' scenario. The 'vendor' goes to the court and pleads poverty and can only pay $5.00 per week, or some other meaningless sum that equates to the cost of a burger or coffee that makes no impact whatsoever on the bottom line in Sully's bank account, an amount that has exactly the same impact on the 'vendors' bank account.

So what exactly has Sully achieved other than she was in the right and he was in the wrong, along with a whole lot of stress and hassle !

Before they can get away with the $5 a week they will have to go through an Order for Examination which they may wish to avoid as it can bring up a whole lot of other dirty washing

Getting back to your original post Op how did you find out about these faults was it the panel-beater that has given you this appraisal or was it someone else. Just asking because I have a few mates that are panel-beaters that know nothing about engines

Well just thought I would give an update.It turns out that their was most definitely a case for this.Because the seller claimed the engine was in excellent condition on the add it is a misrepresentation.Also even though it was sold as is, this means that if it breaks after it is sold then I have to suck it up but if it was sold with a pre existing condition that he failed to disclose then you also have a case.

On a good note I let the guy know that we had a strong case and he refunded my money less the listing fee.Lesson most definitely learnt but now of course my major concern is if someone else also falls for the add.I hope he has the decency to now sell it with full disclosure.

splinter67 it was through a well respected panelbeater who also does mechanical repairs.He spent time looking at it and showed me the cambelt and that it was worn, slack and covered in oil.I was so worried about the rust I failed to notice an empty radiator and whilst looking at the vehicle in the shade I didn't notice the massive oil leak at the top and side of the engine.When the bonnet was opened again with the sun shining in it was very noticable.Yes, silly me but I completely fell for the well written advertisement and the seemingly honest man.

Slightly wandering off topic (apologies OP) but I had the belt changed on a car I bought once and the guy showed me the old belt when I went to pick it up.Because of a seized tensioner the belt was "very close to snapping" - it was 3/4 sliced through across the belt!He reckoned the life left in the belt was measured in minutes.

Don't buy cars from people that seem to turn them over often.They usually buy stuffed ones and then fix them to the minimum standard for as little as possible to make as much on them as they can.Any yeah. I totally agree with the Misti comments.Never owned one never would.

IMO $1200 is still nothing for a student (and yes, I am a full time student) especially when it comes to cars. Definitely more worthwhile to save a bit longer and end up with a car that won't cost you heaps as bits continuously break down!
