'cum' is actually quite commonly used and is correct in that instance.

I think it sucks that you gave him anything people that go down this path are setting precidents that the referees see and think rightly or wrongly that everybody should be paying idiots like this back money when they are clearly not due anything.

Agreed, The adjudicators (which I mentioned earlier on) only have to get an agreement from each side on the day to do their job and be able to lie straight in bed that night. They don't give a shit if either party gets a raw deal.

Can't actually believe the adjudicator entertained this case for two and a half hours as well. You didn't mislead the buyer. He purchased from a private seller. Tough shit, life sucks when you make bad choices. Especially when you have to tick them up at 20%.

Sorry - I'm gonna have to agree with the rest of the posts. That guy should not be getting ANYTHING, and yeah - it's potentially setting a precedent for future cases! But. if you're happy with the results. that's what's important.

HI Folks it's early in the morning but I am presently on a different time zone. So it's actually time to get up.
I know I said the last post was my last post ,but I guess I did actually lie.guilty.
But in the hearing I learnt something about myself that I would like to share. Something I didn't think I had the capacity for. And as tough as we all can be it surprised the hell out of me.and cost me $1000 :)
I fully went into that hearing with the attitude that this little shit has caused me no end of stress and hassle for my wife and I. You have no idea the crap he has sent me. I thought I was going insane at one point and sadly lost my cool on a couple of occasions. And normally that doesn't happen. Life is too short to get wound up over this stuff. But this was special stuff.
We did spend a full 2hrs 30 going over this issue and a lot of it was this mans ramblings.sometimes not coherent and sometimes very needy. It became very apparent that there was no way he would win. He knew it and I knew it.
I was able to relax as it went on and actually began to listen to him. The knowledge of the fact that the system actually backed my position helped make the process stress free. From my point of view and with the precautions I took I was going to be released from any blame or cost whatsoever.
I was able to look at the situation from his point of view. And although Iwould have handled things differently, I still could get stuck with a situation like he had. There is no doubt that the car he has is a real problem. And will continue to be a big issue for him, money or no money.he's up for a lot more than 1K.
We got to the end of the hearing and make no mistake he had lost and he well knew it. He was a broken man. There was NO requirement to pay him anything and he would have not been expecting me to.either was the adjudicator.
Until you find yourself in a situation like this I guess you won't know how you will react. It was like the old Roman battles in the Auditorium where you have crushed your opponent and the Emperor signals to take him out. ( I know I'm sounding a little like him now:))
I just couldn't do it. I felt the point had been made. I fully believe he knew he had made a cock out of himself. I suspect due to his odd style that he has some sort of mental impediment which would certainly explain things.
I am not a Born Again, or Scientologist or any of those wonderful things, however I felt I needed to do something for this guy. I know some of you think he would have gone off laughing.but trust me he didn't. After 2hrs 30 with this guy you would understand why.
I surprised myself.
I'm as rough and tuff as the hard asses amongst you but life is a strange thing sometimes and when you least expect it something will surprise you.
I don't regret my actions for a minute and would not have handed anything to some arrogant sycophant which his letters had me believing.
So I hope that helps with the consensus that I have perpetuated this mans desire to do foolish things. Or not.

I can see Phil's pov. This way he kills the whole matter and avoids any further stress of this idiot trying to further use the court system. he wouldnt win but it would still be ongoing. This way its final and probably $750 well spent.

Phil -I concider myself to be a fair and reasonable person in my dealings with other people.I do always try to keep people happy for personal and commercial reasons. But Mon I gotta tell you that man would have gotten EXACTLY what the court ordered and not a penny more out of me. So I admit you are a better man than I am.

Phil you are probably the man some of us would wish to be, I'm not so sure I'm up to your standards. I think it's a case of we would have to live through the whole process you lived through to find out. You are very eloquent compared to a lot of us on here, reading your last post sort of gave me similar feelings towards Mr G, I don't know if those feelings would have been strong enough to open my wallet up like yours was though.

Kudos to you. You have my respect for both your handling of this extremely stressful situation and your ability to be able to see his side after all he has put you through. It is very easy for people to criticise your decision, but they were not there. Thank you for sharing this story - it has been an amazing read. You obviously merit the 100% ranking you have.
