LOL . THAT almost gave me a bad dose of eye strain. Which legal dictionary did all that come out of. It's almost like he''s doing a solicitors degree at university & using this as a test case for a class project.

I think google is his best friend.must have googled 'how to write a legally bamboozling letter to completely mystify all that read it' & hey presto!

Gobbledegook expert,
Caveat venditor is Latin for "let the seller beware." Caveat emptor is Latin for "Let the buyer beware"

What a well written letter from that guy. He must be wrong of course but great writing skills. Puts all us hamfisted plebs to shame.

What a laugh, go easy on him, he probably borrowed the money from "mummy"

I don't hold any malice towards this chap at all. I just wanted to know where I stood from a legal point of view. But I suspect he would be hard to love with. And once again appreciate the feedback
mjde,

you could try loving with him. that might help

The guy is a joke, trying to intimidate you with all those legal 'big words'. What a complete tosser! I have sold over 1000 cars on Trademe and NEVER heard such drivel in my life! DO NOT GIVE IN! He bought a very old second hand car privately, without inspecting it first and 9 months have passed! What a loser. Why don't you put his trademe name on here so we can all blacklist him!

The funniest part of the whole thing is that he ticked it up yet tries to come across as some high flyer!
If he takes you to the disputes tribunal, counter claim for costs.

I had a similar situation only mine was after about 18mths as car broke down.Went to DT and offered to refunbd purchase price if car returned in same condition as it was at point of sale.Idiot then said he wanted to keep the car but get his money back as well.He lost.
Same will happen in your case he will lose.
A simple one line letter is all you need.Repeat it each time he writes to you.
"I do not accept any liabilty in this matter and accordingly I will not be refunding any of the purchase price to you."
If you wanted you could add "Any further correspondance from you will be deemed to be harassement and appropriate legal steps will be taken against you"
Cheers and good luck.

Simple, this is what you do: Tell him to "piss off!" If he keeps bothering you can call the police and have him warned for either harassment or even criminal nuisance. Then kick back and have a cold beer!

If the car was sold with a current WOF, and the buyer has contacted the seller again after 9mths .I thought that the WOF was valid for 6mths what has he done to the car in the 3mths it has not been WOF'd!
Things don't add up.
xpfairmont,
Nov 19, 7:17pm
Also, my car just failed WOF for rust. I've had it for 11 years! Now where's that old owner at!! $$$$
chook90,
Nov 19, 7:19pm
Why is it that people lacking in intellect insist on using 500 words where one simple sentence would suffice!
The guy is a dropkick, tell him you accept no liability and if he wishes to debate the issue then the disputes tribunal is the sole remaining avenue available.

So this fool borrows money to purchase an old English "toy" or weekend car without getting a pre purchase inspection. He thinks the AA will be liable for what is now a 21 month old inspection. He also seems to think such a car should have low or no running costs. So when he finds he has to spend tousands of dollars (which he does not have) he looks around for anyone he can possibly blame and leach off. What an idiot.

Dude - what is this world coming to
Time to move to Mexico for the Zeph / Zephette & the Consuls - this country is totally & utterly chokka with people I dont want to rub shoulders with at Push'N'Shove anymore - settle things with some Tequila & a sub machinegun IMHO, much easer than reading that overt POC letter again
Refund - for an MG - LOL Ive had a shower, done a bit in the garage & Im still laughing so had to post
Thanks kiwi69 (dinner for two with a terrible view) You made my night & reminded me why sometimes, this MB is worth a look before bed

you are also facing a problem, he, i feel has created. No pre-purchase inspection, not viewing the car (or at least having a local mg club member look at it) leaves the ball in his court. Was the vehicle mis-represented! i dont feel so, i wonder how bad said rust really is! have you seen pictures of it! I am reminded of Sister in laws car going for a WOF a couple of years back. failed due to "rust on the subframe". marked, was surface rust scale. on a serious bit of metal. according to him, his WOF guide put it in the catagory of a "fail". 3 opinions she got over said rust, all commented that there was no way in hell it was detrimental, and that a hign number of older vehicles they see are similar. no pitting or exploding rust, just surface scale. My point is, what his Wof man, and your wof man see as serious rust can be different. Kaz and supernova has the outstandingly best advice on this to be honest!

This guy has a marvelous way with words, but it doesn't change the matter at all.
Tell him you do not believe you should refund him, either legally or morally, and will not be refunding any money or contributing to any repairs.
Direct him to the disputes tribunal if he wants to take it further. I would be bolshie and send him a completed disputes tribunal application form, just to show my confidence in my position.
Otherwise cease all contact.

This big bad wolf thinks you live in a house of straw, but as you are a smart little piggie you got advice and now live in a house of bricks.
So he can huff and he can puff and he can huff and he can puff all he likes.
And if he tries to climb down the chimney you can burn his hairy wolf arse with a non-molestation order.

The one thing that is probably fueling him on, isyour quote above, that you wouldn't have bought it either, had you known. Still, it doesn't change the facts and he cannot prevail for all the reasons already stated.
