Just ignore all future correspondence .a man that has to borrow money to buy a $9000 car without a pre purchase inspection is a loser.prohabily got his mum to write the letter.Let him take you to Small Claims/Disputes Tribunial just for the entertainment value.

I have to chuckle really, to think he feels he should get '9 months of ownership enjoyment' at absolutely no charge to him and all be at your expense, by wanting 100% reimbursement.
It would be the same as giving a complete stranger your car to use until aug 2013 at absolutely no cost! Anyone who thinks that is fair, is a total moron.

Update on previous discussion for anyone interested in this bizarre situation. Received Papers on Christmas Eve pertaining to upcoming Disputes Tribunal case to be heard on the 27th Feb. Included in the documents is 75 separate numbered paragraphs of similarly written prose. This time he gets quite sarcastic. Accuses me of lying etc.

So will update on the tribunal decision when it comes through. Wish me luck.

Good luck.Remember the DT is part of the Court system so make sure your written response is polite, factual and to the point.I think that the buyer waqtches to muck Judge Judy. :)

did you sell the car as is where is ! big difference I insist on giving a reciept with both of us signing it acepting the term s of sale but be worth seeing a lawyer for legal opinion 9 months later too latemy book

MGBs "crossmember) will (almost) never rust. The front one - supporting the engine is likely to have engine oil on it and is made of incredibly heavy steel. The two crossmembers for the gearbox and similarly made + have oil from the engine and gearbox seeping on to them (if they don't its a bonus). Perhaps they're talking about the sills running under the doors. They often rust - sometimes a little, often a lot.
As others have said - its now their problem. I have 5 MGBs and have replaced 8 sets of complete sills. Enjoy your holidays.

I'm enjoying reading this. Keep us posted. I really think you'll be fine and hope you win this. The guy's a jerk - his use of long winded sentences and unnecessary wording - he just comes off sounding like a pompous git and a fool at that. Fancy trying to recoup money over rust on an old car after the sale was completed nearly a year ago. pretty weak.

If "Carters" say there is rust in the cross member then there is. or maybe the buyer is confused-maybe need to sight the wof reject or talk to garage
Paul Carters been around MGs for a long time so would besurprised if they are wrong.

i work for a law firm (not as a lawyer mind you) but I know for a fact the lawyers are told to make things as plain English as possible, he is just trying to look smarter than what he actually is.

the buyer sounds awfully like a person my ex boss had a run in with a year or so ago.also Dunedin based .also went to disputes tribunalalso liked to invent legalese and imaginary costs usually hugely inflated.hhmmmm

Good Luck. You've got time to carefully work out your responses and put pen to paper. As mentioned, don't get hot headed, either in writing or in person. I think the majority here all agree that this guy doesnt have much hope. The one and only dt hearing I went to I made some notes to myself on a small card and just spoke honestly. Don't feel you will find it intimidating 'cause it really isn't. oh yeah, please post back and let us know how you got on :)

Good luck.been interesting reading.I tried to read his letter again & got lost in the gobble-de-gook legal jingo he was trying to portay.gave up after one or two lines.lol too hard to comprehend.
And only 75 seperate numbered paragraphs! Love to be a fly on the wall at the tribunal hahaha

Keep calm, be well prepared.

Write down what you want to say in reply so you don't forget anything, keep it to the point (unlike the verbose fellow).

Print out the trademe listing and take it.

Print out all correspondence you have, mark important ones so you and the mediator can find them easily, and take it.

It would perhaps be useful to also print and take this thread where many people in the industry and with MG experience have given good opinions in your support.Mark the important ones.

1.If you cant get the listing anymore TradeMe will help you and email it to you.
2. Printing out this MB myahelp but do remember none of the posters have seen the problem car.
3.As you no longer have access to the car (I presume) it makes it hard for you to get a qualified opinion on the problem.If that point comes up at the DT ask for matter to be adjourned and car made available for independent inspection.
4. Do you still have the WOF check sheet fromn when you sold car!If not try and get a copy.If there was rust present it should have been mentioned.If its not mentioned then I'd say (hope) your case is won for you.
5. Unless you are an expert on MGs do not try to make out that you are.In some respects the dumber you can be the better as the average joe blogs wouldn't have a clue about where aMG rusts etc so the average joe blogs simply relies on the wof inspection to find such problems.
6. If you go back to my very early post in my case I was asked why I sold the car.Answer didn't have a use for it any more.was then asked how many cars I had.Answer 7 or 8.Then asked why didnt I sell the other 6 or 7 rather than the one I did.Answer the one I sold was the one I used the least.then asked why was that.Answer (by this time I getting just a little peeved) so said didn't want to put the pig dogs on the leather.He gave up on the stupid questions then.
7. At the hearing take ytou time, don't rush your answers and say as little as possible.He, as the applicant, will have his say first, listen (don't interupt) and make notes.I know it's going to be hard but do try your best not to laugh!.Only respond when he has finished.

And finaly if for some strange reason you loose remember you can apply for a rehearing and can file an appeal in the District Court.

Good luckany sensible referee will throw it out(9months !).If your going ,take every piece of paper ,Emails, yourprepurchase insp,service records , WOF sheetETC .Dont gethet up at hearingbe cool & calmdont exagerate anything, dont accept 50 % , chances are hes aleadyi inflatedthe costway over that .&bet hes done it before, it soundsfamililar .
