I'm guessing you don't read too well. Actually, that's not really a guess - evidence indicates it's a fact.

andrewcg53, Jan 1, 10:57pm
Go to court, you have the right to see a radar speed of you car if they don't have radar no ticket can be issued.

meathead_timaru, Jan 2, 12:01am
Ignore this post. Everything he's said is wrong.

truckr, Jan 2, 1:42am
document witnessing can be done for free at the courthouse and signed by a court registrar

snoopy221, Jan 2, 1:52am
Well we do have a *Bill Of Rights* in this country.
That is to give citizens a right to defend accusations from the crown.
The crown in this case have made an accusation
Against the evidence of 3 witnesses-and without formal proof.
The process is such that in time the unpaidticket comes initially before two justices of the peace.
And is either defended there-or proceeds to a court hearing before a judge.

As to where all 3 witnesses were seated and how clear a view they had of the speedo!
And how accurate the speedo was/is!

A video of the speedo and the reading on a roadside speed trailer would be a start-and cheap.
A calibration certificate by a speedo repairer to certify accuracy would be dearer.
However obtaining the cheaper EVIDENCE and being prepared to obtain the dearer evidence at the initial hearing(Whilst applying for costs of such evidence to be met by the prosecution)

May well result in the Police being able to offer
No Evidence
Apart from the Officer's word

Wheigh up the cost . If got plenty of time & $ then defend it .Me id just pay itunless have too many demerit points up&anymorewill mean cancelation .

Do they have Anarchy on the autobahns of Germany or the many other roads in Europe where the speed limit is greater than ours! Short answer NO revenue gathering me thinks. Someone made a very good point earlier that road incidents had risen by 11% depite greater enforcement!

Who checksi the checker

meathead_timaru, Jan 2, 5:47am
Give it a few more years of the simpletons and their retarded "Nothing to hide nothing to fear" mantra and we won't have any of it left worth a pinch of the proverbial. New legislation pretty much runs roughshod over it anyway.

gammelvind, Jan 2, 6:10am
Slight case of cherry picking here, I guess you haven't driven in europe lately, autobahn no speed limits, try getting away with speeding on their local roads and in their towns and I think you would have prefered our revenue gathering police.
As well just try sitting their driving exams in order to get a license, the performance in order to own a car, and I really think you would have quite a different opinion of the NZ Police.

tigress49, Jan 2, 6:59am
Too true! While there may be no posted speed limit on most of the German Autobahns you may be stopped at random, or because the Politzei believe your speed was excessive for whatever conditions they decide apply at any one time. or even for the vehicle you are driving. You will then have to justify the speed you were doing. That is how they monitor speed on autobahns. As for lesser roads they do have posted speed limits. and, by the way, they have large numbers of both mobile and static speed cameras in use.

theram1, Jan 2, 7:01am
That was John Banks mantra.
Nothing to fear, nothing to hide.

lookoutas, Jan 2, 7:04am
Wondered how long it was gunna take someone to come up with the obvious solution.
Write one letter of defence.
If that fails, and demerit points aren't an issue - pay the 80 bucks and stay working instead of wasting half a day or more in court.

doomy999, Jan 2, 7:19am
Somethign you need to learn. Police have "productivity targets" (quota's)to fill.
So they often do not care if you are innocent. They dont care if you write in and get off. What they care about is filling their quotas!

Take intrade's advice. Write in and tell them what a joke it was and that you will fight it. Dont pay!
I can send you an account. It doesnt mean you owe the money. So if you dont owe me, why should you pay! Same applies to the cops, they can issue you with any silly ticket they like. It's up to you whether you fight it or not.

"Superintendent Mark Lammas, the boss of the unnamed officer who wrote the memo, said there was no quota but that officers did have "productivity targets" to meet"

craigsmith, Jan 2, 7:31am
You mean they have speed controls that actually make sense for the the given road and surroundings instead of inane magic numbers pulled out of some wally's whatsit, good enforcement of same, and a high standard of driver licensing so that not everyone on the road is an ignorant and dangerous moron who doesn't know how to handle their vehicle!

Well I never.

spead, Jan 2, 7:58am
his speedo is callibrated . yours isn't. In court you wont stand a chance of defending your ticket. Pay up.

gammelvind, Jan 2, 8:14am
I know, crazy thinking isn't it!

wrong2, Jan 2, 8:15am
he wasnt following - the cop in the OP was oncoming

puddleduck00, Jan 2, 8:16am
Except the cop was moving in the opposite direction.

magnum10, Jan 2, 8:33am
This!
Same thing happened to us,we wrote to NZ police with no avail. There is no requirement for officers to lock in the speed, basically its their word against yours. Reluctantly we let it go as we couldnt be bothered going through the court process.

lookoutas, Jan 2, 8:25pm
That's what 2 of us have already said.
I'ts not the be bothered part, it's the economics of time in going to court.

One thing in OP's favour - there were 3 of them to 1, so make sure there are 3 letters.

anenigma, Jan 2, 8:28pm
That is so much BS - no way on gods earth can he decide what speed you were doing without a radar . what a dick (officer I mean)

ree6, Jan 2, 10:23pm
And all three had their eyes glued to the speedo !

mrsscubasteve, Jan 3, 5:38am
Almost finished my submission, and then its off to a colleague who (conveniently) happens to be an ex-cop and now come lawyer.

Will see how it all goes.

klrider, Jan 3, 7:48am
all three of you were looking at tne speedo!sounds unlikley that you could all say what speed you were doing.however, it would also be unlikley for a cop to be able to prove your speed within ten kph coming towards you, unless he did have a radar, as a previous poster has said.
