Repairing a non-warranted car.

the_joker_, Oct 9, 6:40am
Would an insurance company pay out prang repairs on a car that hasn't been warranted or registered for 18mths! My neighbour has the unwarranted car, and was hit by another with 3rd party cover. He reckons all he has to do is get a quote, and driver at fault will get his insurance to cover repair cost. Surely insurance co would see neighbours car as illegal anyway and refuse claim!

Was your neighbour's car on the road or his private property!

crzyhrse, Oct 9, 7:09am
Having a current WoF or not is not material to the claim unless there is a defect that prevented it from obtaining a WoF that also contributed to the crash.

So, no. They might try to decline the claim but if he persists they will have to pay him. Some here will likely tell you they had a claim declined in similar circumstances but since they didn't pursue it beyond the initial declination they have no idea how it really works beyond that: they think that the insurance company's word is law. It isn't.
Not relevant.

It wasn't his fault so he should get payed out regardless

True, a WOF is not proof of a vehicle's fitness just as lack of one is not proof of unfitness.

However the other party could argue that because of the fact that the car is out of wof and rego for so long the value of the car is very low and pay only a maximum of that amount.

curlcrown, Oct 9, 10:27am
what kind of car is it!

kazbanz, Oct 9, 7:39pm
the Joker Crzyhrse is bang on the money a vehicle doesn't need to have rego or a current wof to be safe for road use -Just illegal
BUT if the vehicle in question is actually DEREGISTEREDthenthat might open up a whole new can o worms.

rob_man, Oct 9, 7:41pm
Not sure about the deregistered thing but as pointed out, it devalues the car considerably.

Years ago I was involved in a car acc where the driver died at the wheel(heart attack)The car went off the road and had to be written off,it was not reg or warranted at time but because the car wasn't at fault insurance paid out full coverage.
