The key point is you are not changing ownership. You are only changing the mailing address for the tickets. Ownership is a legal term/right. Registered owner is only the address for the tickets.

Seems that's not necessary these days. All you need to do to change a car into your name is your licence details and the reg number. The OP didn't even need any proof that they actually even bought the car.Crap system now. Basically it's up to the buyer to change the ownership even though it would be of more benefit for the seller to make sure the ownership has been changed out of their name.

I am actually with OP the system as far as getting money owed is backwards and totally supports the fraudulent party. I am owed a lot of money on a truck and I know where it is and I am legally allowed to repossess it BUT I cannot go onto their property to get it and it is now listed on trademe but we have a security interest legally registered on it so hopefully some sucker buys it then that wont apply and we will be able to repossess it from them and go onto their property to do so. How is that fair! We have toyed with the idea of doing what OP did but then report it stolen as well but so far we have kept it all legal and our lawyer costing us a fortune won't let us steal it even though it is very tempting but yet we are the innocent ones and some scum can get away with running up debts all over town and its me that gets the legal bill. The system is the problem. Hope you get your money OP.

supernova2,
Nov 15, 7:36pm
Piece of cake.Issue the correct notice and then have anyone you choose go onto the property and pick it up.Where is the problem. Also have you reported the lising as clearly the seller is intending to commit fraud by selling something with a security registered over it.
Think outside the square and you will get your truck easypeezy.

Are you deliberately being obtuse danchop, or are you really a TOTAL idiot.NO! NO! You did NOT change the ownership legally because you were NOT the LEGAL owner and ONLY the legal owner can legally change the ownership. You fraudulently (read ILLEGALLY) changed the ownership to a vehicle you did not own.Have fun Dummy - You're in BIG DUDU.

I have already asked and it is not against Trademe rules to sell something with a security interest as he could be planning on selling it to give us the money lol. Just waiting for someone to take it for a test drive for us ;)

This is a country where people who murder their families get out of jail a little over 10-12 years lol.I think the OP isn't gonna 25 to life for this =P

Hi Pebbles, Didn't ya know - this is Bizarroland. Murder and Rape getcha 5-15 years but fraud or spittin' on the footpath gets you 20-25 years.

Hmmm--hey guys I've been reading this thread and thinking a bit about what the OP did. You guys are pointing the finger at the OP and but thinking about it the guy that did the runner committed the initial crime. I would have loaded a security on the vehicle for what was owed. Then the police view it as a civil matter

Look up the liens act on Google. May be of some help to you.

And exactly WHERE did you get the idea that committing a second crime nullifies the first crime. . .OR that two wrongs make it right . . .Duhh

Theft.Alot of vehicles are stolen by the exact process you used. The cops are wise to it& if the rightful owner has historical photos of him With the vehicle you are a thief proven & penalised.Do you have any photos of you and his van! Enjoy the porridge!
deodar1,

This is why we should engrave our ID somewhere obscure on our vehicles.

is the guy with the van bigger than you danchop or has he got big ugly mates he could be on his way round for a little chat maybe the police are a better option they might not hurt you as much

How is loading a security against the vehicle of a debtor against the law! Please feel free to check the relevant legislation around this.-I can give you a link to it if it helps.
bellky,

This is great.
How do you just go loading securities against people's stuff! Surely you'd need some sort of Court order similar (assuming you don't have their consent).

Good idea canceling reg,now if he did have insurance they won't cover him.
supernova2,
Nov 16, 6:04pm
Why!
The simple point is that when and if the vehicle gets involved in anything that attracts the attention of the plod they will be down the OP's throat as quick as a snake. The legal owner of the vehicle has done nothing wrong and IMHO the insurance will still be valid. As for registering a security IMHO you have to have a finance contract which meets the requirements of the legislation.Whilst it could be registered without the contract to back up the registration you have then used a document/computer etc to commit a crime.
If i was the OP I think the best thing he could do would be to go to NZTA and tell them he got the plate number wrong etc and could they please, pretty please, undo the transactions.
