Hi. If the electric rear view mirror doesn't work (won't adjust from the switch), would the car fail WOF! Still can be adjusted by hand though.

I've put cars through with failed mirror electrics no worries.
The legislation is:
3. A rear-view mirror must be:
a) securely attached so that the risk of injury is minimised, and
b) mounted so that vibration does not inhibit the driver??
