I need help please as I am female and I think I have a case against garage but they not backing down.

In November my son too his car to a garage and advised he wanted some modifications done legally and for the vehicle to be certified and than given back to him. He paid $3900.00 up front for a boss kit steering wheel, racing seats, exhaust and labour. It was then up to them to source the parts and do the work to a legal standard. The work was completed and they took to certifier who said all illegal so they had to remove boss kit, air bags, and atach runners as seats were not allowed in fixed position. This took until February this year when we collected car and have now received another bill for $1500.00 for the time and extra parts they had to use to correct the faults. I argued with them as we paid in full to have the car legal and they are now telling me inbetween November and December all certification laws were changed which meant it was beyond their control. Does anyone know of any big changes!

Laws hadn't changed, but the things they had to add on are legitimate reasons as far as I can tell. Maybe they under estimated the job or didn't have a full understanding of legislation prior and under quoted the job.

They told me they were experts in these modifications and we advised son could not pay more than the $3900.00. They assured us they knew what they were doing and had spoken to certifier. Their excuse now is rules changed in the week they worked on the car.

Maybe you should ring the LVV Certifier and see what they have to say about the vehicle!

I agree totally. Have a chat to local certifier. The garage you are dealing with should have known of these changes and advised to you prior to commencing work. If they didn`t know, then the certifier they had spoken to definately should have known. Did you get a written quote! Or was a verbal agreement. Either way, it seems you do have a case against them.

We had a written quote which we accepted, and then an invoice which we paid in full. They are now saying the invoice was an estimate but there is nothing on the tax invoice which shows this.

You have a written quote which you not only accepted but have been invoiced for and paid.

IF (note caps) the installer can demonstrate that there has/had been a change to LVV certification rules that negated that quote in the interim then I have no idea what the legal position is HOWEVER I do not believe there has been a change to those rules in the time period mentioned as far as fixed seat are concerned.

Frankly it sounds like they messed up, didn't understand the regulations and have tried to hang the cost of that error on you.

son sounds a bit precious, why didn't he get dad or some body to help him and do it himself. This type of work is not that difficult, seems like you've been stung by the labour charges.

Not precious, just works long hours and therefore can afford to pay a professional to get it right

Don't then. Don't pay anything until you get further advice on courses of action open to you. Also, don't have anything more to do with the garage -they have been clear on what they want . you to pay up. If you have to have contact with them then you need to record or document what was said by who and when. You don't want this to turn into a 'he said you said' sorta thing if it ends up in court.There has been some good threads on this board about stuff like this. Have a look. I assume you have the car back in your possession! I'm guessing this is only going to conclude in one of 3 ways; You pay in full, you come to a agreement where you pay an agreed portion or, you pay nothing. There are some smart cookies that frequent this board that know the options open to you and can advise. Good luck.

If something had changed, they'd have known in advance or they're not the 'experts' they claim to be.

Definitely not an estimate. We got tax inv which was paid before work commenced.

With this in mind I think you really have nothing to worry about. Tell them to take a flying jump and keep any written correspondance from them. Don't respond, they will most likely go away as they havn't a leg to stand on pursuing this. Good luck.

seats dont need rails i just had my vehicle certed on the 18th of this month without rails. Im not sure about the steering wheel without knowing exactly what was done. These are the current cert rules

Sounds like your're being BS'ed to me, who would be silly enough to go ahead and do the work without consulting an LVV certifier immediately beforehand, they were paid to do a job properly and if your requests weren't legal you should have been advised beforehand.IF any rules had changed the certer would know well in advance before implementation date.They didn't do their homework and want you to pay for it. As above I'd talk directly to the certifier.

Not sure at all about some of this, but I rang LVVTA last week and you couldn't wish for a more helpful bunch.My problem was a bit more complex, but the culmination was that the certifier (who correctly) wouldn't allow something according their rules, but then lobbied on my behalf for an exemption, that was granted withih two days.

Over the last 8 years, my car has been subjected to a lot of change (only the bodyshell and doors are original!) and the certifier was involved almost from day 1, but rules do change faster than they can keep up with.Even though most of my work was done by respected professionals, they don't all know the rules or even the procedures.Several items that the certifier was happy with during the build are now no longer legal and have had to be changed.

I only found out in December of 2012 thatI was suposed to submit to LVVTA, a 20 page form that detailed all the work that had been done (or was proposed), plus - a requirement for full working drawings of the modified suspension accompanied by crack test certificates (I knew about that part only, back in July).

When I mentioned the 20 page form to the workshop who specialises in modified cars and race car preparation and who started the work back in 2005, they were totally unaware of the existence of it.

My car has fixed FIA seats.

Yep, everyone has said don't pay but what does she do from here! Does she contact them and tell them that she disagrees with the extra cost and is not going to pay and if they want money out of her - then they will have to take legal proceedings to get it! Does she close her eyes and hope it goes away! What!

you don't even need adjusting rails for a wof. if fitted, have to work, but not required
