But they absolutely would be able to see what it (ECU) does in terms of engine control, without analysis at code level. If they didn't trigger the emissions defeat in testing, they should still see that something was seriously wrong with exhaust gases. If they did trigger it, then they should see something seriously inconsistent with fueling etc.

I don't think this bodes well for aftermarket CPU services. That's likely to be made illegal anywhere that has emission regs. Of course catching car owners with chipped/flashed ECUs may be hard, but the folks selling the services would have to go to ground.

just look at what tuners can do to Mazda ECU's. they have cracked the factory code and worked out what the hundreds of maps do. they have even added turbos to cars and are running 300+Hp on a factory recalibrated ECU that will happily pass emissions testing and drivability is like a stock car. tuners like "OVTUNE" and "tuning done right" do it as thier bread and butter jobs

Surely if they pass Euro standards it should be good enough . But of course yanks have to have their own set of rules to comply to . Why not just accept Euro as the standard .?

2) Because the Euro testing standards are also crap.

To clarify point #1 above, even if the Euro 6 measurement passed, the use of "defeat devices" as VW have admitted are used on the 11 million affected cars, is prohibited under regulation (EC) No 715/2007:
Article 5

1. The manufacturer shall equip vehicles so that the components
likely to affect emissions are designed, constructed and
assembled so as to enable the vehicle, in normal use, to comply
with this Regulation and its implementing measures.
2. The use of defeat devices that reduce the effectiveness of
emission control systems shall be prohibited.
