I would think that in Oz trying to argue with an Insurance company when you have no insurance yourself could be a lengthy and expensive business lawyer wise.

You have photos, and your car is not white (as was indicated in the other accident the other driver had). Call them and politely ask their insurer, then go in and show them what REALLY happened. I'm sure you could get off everything altogether when the company realises they've been committing fraud and want absolutely nothing to do with them regardless of what happened. My father has worked in insurance for 25 years, they DO NOT go lightly on people committing fraud, trust me.

Sounds like it had quite a decent shunt in the front, but if you're certain it wasn't shunted into a car in front, then that's got nothing to do with you.
If the assessors photos show different damage to yours, you need to show them you have the evidence. Take the photo's off the other computer and post them - not hard to do if you've got a Flash-stick.

Not unusual for the mounting tabs of lights to break off when they've had a tweak. Ditto re unseen damage behind bumper.
Rough price that might help;
$300 labour (viewing without bumper off)
$300 paint
$230 T/light

Thanks for the replies.will get the other pics up (assessors) soon.

Seems the insurance company is well aware it's a fraudulent claim, but seeing as they have already fixed everything up they want someone (us) to pay the bulk of it.

Neither us nor the insurance company will ever be able to prove what damage was caused by whom.

So if it goes to court it's a complete lottery. It'll be what the judge decides on the day.

Being in this game I can tell you that some people will try and claim some damage that quite cleary has no relationship to what has actually happen.
Its amazzing how one opossom can damage, 2 side skirts, one front bumper, one front gaurd, one rear bumper and so on. Insuance assessors are not that stupid.
Geez one silly girl wanted (claimed for) new front struts entire side of car repaired for some bumper damge on a $1500 car tops. oddly enough she got her bumper fixed and thats all.
Dont give in if you think your being shafted.
How did the front light get damaged!

The front light got damaged in the second accident, along with all the other components shown in the assesors photo's.

Taking a photo of a bumper does not say anything at all.There is no way you can quantify the damage to chassis and internals of a car by taking a photo of a bumper.I am not saying that the damage was exaggerated or not, but still sounds dodgy nevertheless.

Taking a photo of a bumper in itself proves nothing, but when compared with the assessors bumper pictures the car has clearly taken a heavy knock in the right rear in a seperate incident after my wifes impact. There are white paint smears on the right rear of the bumper that are clearly not evident on the pictures my wife took indicative of a secondary impact.

If you take the photos in and show them to the owners insurance company I'm sure they will be having not so quiet words with them. There is no way they'd be dumb enough to believe them after that.

Your wifes photo doesn't really show enough to prove there was no white marks. But the marks shown look more like the car has hit a pole/post.
It can be clearly seen that panel damage has occurred behind the bumper, as always happens.
What colour is your car! If not white - that would be a good fact.
Was there a vehicle in front when your wife hit the car! If there was no chance that she shunted it into another car, then the frontal damage has got nothing to do with you. Surely if this happened there would be someone else knocking on your door.
If you can prove doubt as to what damage your wife presumably caused, then you could just about tell them to go sing for there money.

Wifes car is red, and she did not shunt the car in front.

My wifes pictures, for all their cellphone shitness clearly show that the damage she caused did not include the white paint smears on the R/R bumper.
Subsequently a major component of their revised quote includes the heavy damage to the R/R quarter.

My wife hit the Toyotas rear.FRONT on, no L/R or R/R impact.

I understand everyones individual opinions, and I understand I should have had my wifes car insured.

However, if I roll over and take it up the arse like many of you have suggested I will be handing over my dignity and morals to big business.

We are not trying to worm out of liabilty or anything like that.

Sometimes you have to fight for your rights. We offered them a fair settlement to the value of 900 AUD and they refused.

Only problem you run into is a court gives a verdict, either YES or NO. a tribunal can be Mr Fair, and not find either party guilty or innocent but can offer a remedy that is fair and just.
