our justice system and the police ird and other gov deps all need a major overhaul , brought in line with aussy systems jails the same ,2 much corruption there and here but there has to be a medium where things do work for society and drinking and killing with a car is manslaughter as much as we d hate to be in that position 5 years jail first time 10 yeras 2 nd time and we ll break their legs ,sorry bout my typing it bites me every day thatthe road toll still climbs with the many many fartwitss on the road that kill

a texting drunk driver killed my sister nearly killed my niece she was a well known lass in the southland area was a mum a wife had lots of passions , wiped on a sunday morning drive only she never got home again .sucks no end I tell ya

My brother lives in Denmark, 1st DD offence is no license for 12 mo. Fully loss of car for ever. 2nd offence no license again, but for ever, and jail.
Should be same here.

Totally agree .our judges are a disgrace !Can't believe how weak they are .what on earth are they afraid of ! .that they might hurt the feelings of some drunk creep who has just mowed down an innocent family. Should be zero tolerance for all .caught and it's permanent vehicle confiscation and loss of license for life. How hard is it to not drink and drive !

Why do you all blame the justice system for drunk drivers! Stiffer penalties wont stop people dying.
It's not the justice systems fault they drove drunk & crashed.
Perhaps they are alcoholic, so not entirely capable of making the rational decision to NOT drive.
Who are these people drinking with who allow their friends to get behind the wheel drunk! Workmates, brothers, relations, bartenders. Should they be held more responsible!

I'm not making excuses for anyone.
I just think part of the answer lies elsewhere.

The law should be on the level of alcohol in the breath/blood.

For instance. For the first offense anywhere between 80-120mg in the blood will mean loss of license for 5 years and NO EXEMPTIONS!

For the first offense anything over 120mgs 15 years NO EXEMPTIONS !

And for any second offense, minimum jails of 3 years and loss of license for ever NO EXEMPTIONS !

Third offense 10 years minimum jail NO EXEMPTIONS ! Even if on your 3rd offense you are only just a fraction over the limit, 10 years minimum !

and the reality is that none of the above will happen

$130k to keep a prisoner inside for a year, you want to waste $750k for first time caught and $1.6m for second

sensible sentencing yes but that is crazy sentencing, you'd have better luck calling for the death penalty to be reinstated, and then the lawyers would keep making the same $1.5m keeping the offender alive

as someone esle has already pointed out - jail time won't fix it, harsher penalties won't fix it

society has to fix it, and for that to happen society has to own the issue and change the social perception of drinking and driving
it is still a challenge to drink and drive and get away with it, society has to change that attitude
