Technically a fail, morally fine, depends on how staunch the inspector. If failed, would take it to a branded tyre store & get them to supply a signed cert sheet for it "as safe" then go back to get your wof

True but you may only ever see that customer once, by helping them with a simple cert on a simple diagnosis, you may well see them & others of their friends again for more business.

According to the VIRM unless there's cut cords the split has to be "b) a cut or crack in a sidewall or tread more than 25mm long that reaches the cords, " so you could only say it was a fail if you could see cord damage.

Yep but without being able to personally inspect the "cut", we can't say for sure.
