Its to do with its safety design and the lack of, not drivers action. Its proved had the cars seat belts been anchored safetly Walker would not have burnt to death as the accident was survivable.

nothing has been proven! He may have been alive, but was he conscious enough to get himself out? Could he even get out without being cut out?

Stupid! The cause of death was the car accident. Any safety device can only do so much and is always a compromise. In very few cases it has been said it would have been better not to have worn a belt, better to fly out of car. Sure, but in majority it is.
This kind of suing is what is very wrong with US legal system, and culture.
