Car Dealer Refunds Car Purchase ?

Situation: Seller (Car Dealer) sold car with new cambelt, cambelt failed and destroyed engine within 3 weeks of purchase. (approx 300km since purchase)

Seller has offered to refund purchase price, however within the 3 weeks approx over $1,000 was spent on car. Panel / Spray Paint, Service, New CD Player (existing did not work, not disclosed in auction)

As seller is getting car back in better condition, is he obliged to contribute for improvements !

Probably not really, what you did to car after you got it probably dosn't add to much value as such but I would take your CD player out and be happy with the outcome. He has or is refunding the purchase price so thats possably all he needs to do. The car will proabaly be worthless (depending on current value) to him now apart from parts anyway so it will be his loss.

Purchaser can choose - return car as puchased (with stuffed engine of course) and get refund or have fault rectified. Purchasers choice and not dealers. So if you are unhappy request repairs done.

Auction car. Argueably get narky with dealer.Dealer says deals off it was an auction car no refund.
Best outcome you can expect is refund in full. Take the sterio out and concider yourself lucky the dealer has agreed to full refund.

Assuming it was an auction, then yes as kazbanz says, take what you can get because they are not obliged under the CGA otherwise.

I think you are correct. If the repair costs more than the purchase price the dealer may have the choice. But if the repair is the same or lower then the purchaser can dictate. The tribunal then must (and will) act on purchasers request of repair or return.
